HomeMy WebLinkAbout05800ORDINANCE NO. 5800 AN ORDINANCE AMENDING SUBSECTION (1)(D) AND SUBSECTION (7) OF RULE 26 OF CHAPTER 13 OF TITLE VI OF THE 1971 CODE OF ORDINANCES OF THE CITY OF PUEBLO TO CONFORM TO AMENDED LANGUAGE IN THE CONSTITUTION OF THE STATE OF COLORADO WHEREAS, at the November 3, 1992 general election, the people of the State of Colorado voted to amend Article XII, Section 15 of the Constitution of the State of Colorado by striking the phrase "unremarried widow" and adding the phrase "surviving spouse ", and thereby to grant veterans' preference points on certain civil service examinations to the surviving spouse of a qualified veteran; and WHEREAS, the people of the State of Colorado have also voted to amend that section by striking the reference to the Spanish - American War; and WHEREAS, the veterans' preferences granted by Article XII of the Constitution of the State of Colorado are applicable to the civil service system of the City of Pueblo, and WHEREAS, the City Council wishes to conform the wording of Civil Service Rule 26 to the current wording in the Colorado Constitution; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO that: (brackets indicate matter being deleted; underscoring indicates matter being added) Section 1. That subsection (1)(d) of Rule 26 of chapter 13 of Title VI of the 1971 Code of Ordinances of the City of Pueblo is hereby amended to read as follows: (d) Five points shall be added to the passing grade of any candidate on each such examination, except any promotional examination, who is the [unremarried widow] surviving spouse of any person who was or would have been entitled to additional points under paragraph (b) or (c) above, or of any person who died during such service or as a result of service - connected cause while on active duty in any such branch, other than for training purposes. Section 2. That subsection (7) of Rule 26 of chapter 13 of Title VI of the 1971 Code of Ordinances of the City of Pueblo is hereby amended to read as follows: (7) This Rule shall be in full force and effect on and after July 1, 1971, and shall grant veterans' preference to all persons who have served in the armed forces of the United States {from the Spanish - American war as of April 21, 1898, and} in any {other} declared or undeclared war, conflict, engagement, expedition, or campaign for which a campaign badge has been authorized and who meet the requirements of service or disability, or both, as provided in this Rule. This Rule shall apply to all competitive examinations, except promotional examinations, conducted on or after such date, and it shall be in all respects self - executing. Section 3.
