HomeMy WebLinkAbout05772ORDINANCE NO. 5772 AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM B -2 TO B -3 COVERING A PARCEL OF LAND COMMONLY KNOWN AS 67 - 79 LEHIGH COURT SUBJECT TO CONDITION SUBSEQUENTLY BEING MET BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1. The zoning restrictions covering the following described property be changed from B -2, Subregional Business District, to B -3, Highway and Arterial Business District, and, upon passage of this ordinance, zoning restrictions affecting B -3, Highway and Arterial Business District, shall apply to said property: Lot 3 less the Southeast 100 feet by 100 feet and a strip of land lying along the Southerly property line of Lot 3 commenc- ing 100 feet west of the Southeast corner of Lot 3 and continuing 77.74 feet West to the Easterly line of Lehigh Court being 25 feet in width and all of Lots 4, 5, 6, and 7, Lehigh Square Filing #1, Pueblo, Colorado, and more commonly known as: 67 - 79 Lehigh Court. SECTION 2. This zoning ordinance, upon recommendation of the Planning and Zoning Commission, is approved with the following condition: the property owner or his heirs, successors or assigns shall maintain not less than a 35 foot front yard setback from Pueblo Boulevard for all buildings or structures. This ordinance shall remain in affect until modified by subsequent ordinance of the Pueblo City Council. SECTION 3. This ordinance shall become effective immediately upon final passage and approval.
