HomeMy WebLinkAbout05769ORDINANCE NO. 5769 AN ORDINANCE AMENDING CHAPTER 4 OF TITLE XVII OF THE 1971 CODE OF ORDINANCES RELATING TO REQUIREMENTS FOR HANDICAPPED PARKING BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: Brackets indicate material being deleted; underscoring indicates new material being added.) SECTION 1. Section 17- 4 -44(e) of Chapter 4 of Title XVII of the 1971 Code of Ordinances, be amended as follows: [17- 4 -44(e) Handicapped Parking Spaces. A minimum of one handicapped parking space shall be provided for each nonresidential parking area in excess of ten (10) required parking spaces unless the ap ^-licant demonstrates that said handicapped parking space is unreasonable for the intended use. One additional handicapped parking space shall be provided when this ordinance requires more than 25 but less than 100 parking spaces. For each additional 100 required parking spaces one handicapped parking space shall be provided. Handicapped parking spaces shall be located as near as permissible to the nearest accessible handicapped building entrance or sidewalk entrance. Each parking space shall be provided with an R7 -8 sign as described in the Manual on Uniform Traffic Control Devices. The painting of adjacent curbs, bumper stops or handicapped symbol shall not be required; however, if such curbs, bumper stops or handicapped symbol are painted they shall be painted the standard handicapped blue color.] 17- 4 -44(e) Handicapped Parkinq All parking facilities shall comply with the American with Disabilities Act Accessibility Guidelines for Facilities and Buildings (ADAAG) (28 CFR Part 36, Public Law 101 -336). In parking facilities that do not serve a particular building, accessible parking shall be located on the shortest accessible route of travel to an accessible pedestrian entrance of the parking facility. In buildings with multiple accessible entrances with adjacent parking, accessible parking spaces shall be dispersed and located closest to the accessible entrances. (b) Parking Spaces. Accessible parking spaces shall be at least 96 in. (2440 mm) wide. Parking access aisles shall be part of an accessible route to the building or facility entrance and shall comply with ADAAG accessible route requirements. Two accessible parking spaces may share a common access aisle (see 17- 4- 44(e)(2)). Parked vehicle overhangs shall not reduce the clear width of an accessible route. Parking spaces and access aisles shall be level with surface slopes not exceeding 1:50 (2 %) in all direc (c) Van Spaces. One in every eight accessible spaces, but not less than one, shall be served by an access aisle 96 in. (2440 mm) wide minimum and shall be designated "Van Accessible" by an additional sign mounted below the symbol of accessibility (see Figure below). The vertical clearance for such spaces shall comply with Section 17 -4 -44 (e)(3)(e). All such spaces may be grouped on one level of a parking structure. (d) Signage. Accessible parking spaces shall be designated as reserved by a sign showing the symbol of accessibility. Spaces complying with Section 17- 4- 44(e)(3)(c) shall have an additional sign "Van Accessible" mounted below the symbol of accessibility. Such signs shall be located so they cannot be obscured by a vehicle parked in the space. The sign shall be an R7 -8 sign as described in the Manual on Uniform Traffic Control Devices (as shown below). The bumper stop or curb head shall be painted with the standard handicapped blue color. The painted handicapped symbol shall not be required: however, if the symbol is painted, it shall conform to the International Symbol of Accessibility Proportions Section 17- 4- 44(e)(4). i '. ✓i�I. (2895 mm) at accessible passenger loading zones and along at least one vehicle access route to such areas from site entr and exit(s) shall be provided. "Van Accessible spaces shall be provided a minimum vertical clearance of 98 in. (2490 mm) at the parking space and along at least one vehicle access route to such spaces from site entrance(s) and exit(s). (f) Passenger Loading Zones If provided passenger loading zones shall provide an access aisle at least 60 in. (1525 mm) wide and 20 ft (240 in.) Section 17- 4 -44(c) of Chapter 4 Title XVII of the 1971 Code of Ordinances shall be amended to read as follows: (c) Design Standards The design standards are controlled by parking regulations of this Title. The number and location of access entrances and all curb cuts shall be limited and subject to the requirements of this Title and approval by the City Traffic Engineer. Parking standards, including parking angles and space dimensions, that must be complied with are set forth in Section 17 -4 -45 of this Chapter. Each parking space shall be a minimum of 9' x 18' in size except [in the case of] for compact car and handicappe parking spaces. SECTION 3.
