HomeMy WebLinkAbout05765Reception 982744 8/17/1992 ORDINANCE NO. 5765 AN ORDINANCE APPROVING THE PLAT OF PUEBLO CENTER FILING TWO SUBDIVISION BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: CV0MTnTT 1 The final plat of Pueblo Center Filing Two Subdivision, being a sub- division of land legally described as follows: A portion of Block 62 in Hobson's Subdivision to Pueblo, according to the amended plat of said Block 62, filed for record August 8, 1888; AND A portion of Lot 12 and all of Lots 13 through 16, both inclusive, in Kretschmer's Subdivision of fractional Block 44 of the Original City of Pueblo, according to the recorded plat thereof, filed for record March 1, 1882; AND Those portions of vacated Richmond Avenue and vacated Victoria Avenue (River Street) adjacent thereto and being more particularly described as follows: Considering the monument line of Union Avenue, as platted in said Kretschmer's Subdivision to bear N.45 21' -15" E. and all bearings contained herein being relative thereto. Commencing at the Northernmost corner of the two (2) Western- most corners of Block 1 in Pueblo Center, Filing One, accord- ing to the recorded plat thereof, filed for record August 10, 1988; thence Southwesterly, along the Southeasterly right -of- way line of Union Avenue the following two (2) courses: 1. S.45 21'- 20 "W., a distance of 40.00 feet to the monument line of said vacated Richmond Avenue; 2. S.45 21'- 15 "W., a distance of 4.00 feet to the True Point of Beginning; thence S.44 ° - 33'- 31 "E., parallel to the Southwesterly line of said Block 1 in Pueblo Center Filing One and to the monument line in said vacated Richmond Avenue, a distance of 141.11 feet to the Northwesterly line of the alley platted in said amended Block 62 in Hobson's Subdivision; thence S.45 21'- 15 "W., a distance of 150.00 feet; thence N.44 ° - 33- 31 "W., a distance of 141.11 feet to the said Southeasterly right -of -way line of Union Avenue; thence N.45 21'- 15 "E., along said right -of -way line, a distance of 150.00 feet to the Point of Beginning, containing 0.486 acres, soon 2699 � '�H 34 is hereby approved. All dedicated streets, utility and drainage easements, rights -of -way and land set aside for public sites, parks and open spaces shown and dedicated on said plat are hereby accepted for public use. SECTION 2. The acceptance of such dedicated streets, rights-of -way, utility and drainage easements, public sites, parks and open spaces by the City does not obligate the City to maintain or repair same until such streets, rights -of -way, utility and drainage easements, public sites, parks and open spaces have been constructed and installed in compliance and in accordance with the requirements and provisions of Chapter 4, Title XII of the 1971 Code of Ordinances, as amended and any agreement entered into pursuant thereto.
