HomeMy WebLinkAbout05728, ORDINANCE NO. 5728 AN ORDINANCE AMENDING CHAPTER 4 OF TITLE VII OF THE 1971 CODE OF ORDINANCES OF THE CITY OF PUEBLO RELATING TO WEEDS AND UNDESIRABLE PLANT MANAGEMENT BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1: Section 1(a), Chapter 4, Title VII of the 1971 Code of Ordinances of the City of Pueblo is amended to read as follows: 7- 4 -1(a): Weed shall mean weeds, grass, brush or other rank or noxious vegetation and shall specifically include: Bindweed (Convolvulus), Leafy [ Spruge] Spurge (Euphorbia esula), Canada Thistel (Cirsium Arvense), Russian Knapweed (Centaurea pieris), Diffuse Knapweed (Centaurea diffusa), Russian Knapweed (Centaurea repens), Spotted Knapweed (Centaurea maculosa), Perennial Sowthistle (Sonchus Arvense) , Puncture Vine (Tribulus terrestris) , Silverleaf poverty weed (Franseria discolor) , Mouse -ear poverty weed (Iva Axillaris), Fanweed (Thlaspi Arvense), Mustard (Brassiea), Purple- flowered ground - cherry (Quincula lobata), Russian Thistle (Salsola pestifer) , Fireweed (Kochia Scoparia) , Redroot Pigweed (Amaranthus retroflexus), Sandbur (Cenchrus tribuloides), Hairy Stickweed (Lappula Occidentalis), Buffaloburs (Solanum rostvatum), Common Ragweed (Ambrosia elatiov), Cocklebur (Xanthium Commurie), Common Sunflower (Helianthus Centicularis), Dandelion (Leontodore [tavaxacum] , or other plant or 1 offending vegetation which is regarded as a common nuisance. This list is not intended to be exclusive, but rather is intended to be indicative of those types of plants which are considered noxious and a detriment to the public health, and safety, but shall not include flower gardens, plots of shrubbery, vegetable gardens and small grain plots (wheat, barley, oats, and rye). SECTION 2: Chapter 4, Title VII of the 1971 Code of Ordinances of the City of Pueblo is amended by the addition of a new Section 1.5 which shall read as follows: 7- 4 -1.5: Administration jal The Pueblo City Council shall serve as the Undesirable Plant Management Advisory Commission for the real Property within the City of Pueblo to pursue the stated objectives and intent of the Colorado Weed Management A ct Section 35 -5.5- 101 -114, Colorado R evised Stat utes. The president and secretary for the City Council shall annually serve as chairperson and secretary of the Undesirable Plan M anagement A Commission. A _ma Lr it y of t he m embers of the Com mission s ha ll c onstitute _a q uorum _to, con b 2 s (c)_ The Undesirable Plant Management Advisory Commission shall use this ordinance as the Undesirable Plant Management Plan. Such plan shall be reviewed at least once every three years. SECTION 3: This ordinance shall become effective on January 1, 1992.
