HomeMy WebLinkAbout05723ORDINANCE NO. 5723 AN ORDINANCE CREATING AND ESTABLISHING THE DEPARTMENT OF ANIMAL CONTROL AND AMENDING CHAPTER 4 OF TITLE XI OF THE 1971 CODE OF ORDINANCES RELATING THERETO WHEREAS, pursuant to the provisions of Section 4 -6 of the Charter of Pueblo, the City Manager has recommended that a Depart- ment of Animal Control be established, and WHEREAS, due to the increase in activities relating to animals and animal control, a need exists and it would be in the best interests of the City of Pueblo to create and establish one administrative department for all matters relating to animals and animal control, NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (Brackets indicate matter being deleted; underscoring indicates matter being added.) SECTION 1. Department Created A Department of Animal Control is hereby created and established, the head of which shall be the Director of Animal Control. Personnel in the Department shall include such employees as the City Manager and Council may deem necessary. SECTION 2. Functions of Department of Animal Control The Department of Animal Control shall be responsible for the administration and enforcement of all City ordinances relating to animals and animal control including but not limited to Chapter 4 of Title XI of the 1971 Code of Ordinances and such other func- tions as shall be determined by Resolution or Ordinance of the City Council. SECTION 3. Director of Animal Control The Director of Animal Control under the supervision of the City Manager shall be responsible for performance of all functions of the Department. SECTION 4. Ordinance Amendments Section 10 of Chapter 4 of Title XI of the 1971 Code of Ordinances is hereby amended to read as follows: The Director of Animal Control and all animal control officers employed by the City are hereby designated and appointed Humane Officers and peace officers authorized and vested with the power [Humane Officers employed by the City shall be vested with the authority of a police officer and shall be charged with the duty] to enforce the provisions of this Chapter. Such Humane Officers shall act under the direction and supervision of the [Chief of Police] Director of Animal Control and shall be responsible to him for the carrying out of their duties as Humane Officers. SECTION 5. Effective Date This Ordinance shall become effective January 1, 1992.
