ORDINANCE NO. 5707
AN ORDINANCE ANNEXING THE AREA COMMONLY
KNOWN AND DESCRIBED AS 4900 RED CREEK
SPRINGS ROAD
WHEREAS, the City Planning and Zoning Commission has recommended that
the area described in Section 1 hereof be annexed to the City of Pueblo; and
WHEREAS, the City Council has heretofore found and determined by Reso-
lution that the Petition for Annexation and the area described in Section 1
hereof to be in compliance with the notice and other applicable provisions
of the Municipal Annexation Act of 1965 and C.R.S. X31 -13 -104, 105 and
107 (1); and
WHEREAS, the City Council has by Resolution found and determined that
an election is not required under C.R.S. X31 -12- 107(2) and no additional
terms and conditions are to be imposed upon the area described in Section 1
other than those set forth in the Petition For Annexation; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that:
The following described area situated in Pueblo County, Colorado, is
hereby annexed to Pueblo, a Municipal Corporation, subject to the terms
and conditions set forth in the Petition For Annexation, and the official
map of the City shall be amended to show such annexation:
All of the parcel of land described in Book 1536 at Page
48 of the Pueblo County Records in the SE 1/4 of the SW
1/4 of Section 4, Township 21 South, Range 65 West of the
6th P.M.
AND
A portion of the NE 1/4 of the SW 1/4, the NW 1/4 of the
SE 1/4 and the NE 1/4 of the SE 1/4 of said Section 4 and
being more particularly described as follows:
Beginning at a point on the Present City Limits Line, being
the Southwest corner of Westwood Village, according to the
recorded plat thereof, filed for record June 6, 1961; thence
along the Present City Limits.Line the following three (3)
courses:
1. Southerly, along the West line of said Westwood Village
extended, a distance of 20 feet to the South line of
the N 1/2 of the SE 1/4 of said Section 4;
2. Westerly, along said South line, to the Northeast cor-
ner of the said SE 1/4 of the SW 1/4 of Section 4;
3. Southerly, along the East line of said SE 1/4 of the
SW 1/4 and along the East line of the parcel of land as
described in Book 1536 at Page 48 of the Pueblo County
Records to the Southeast corner of said Parcel of land,
being 1010.30 feet North of the S 1/4 corner of said
Section 4;
thence along the boundary of said parcel of land the follow-
ing two (2) courses:
1. Westerly, to the Southwest corner of said parcel;
2. Northerly, to the South line of the said NE 1/4 of
the SW 1/4 of Section 4;
thence Northerly, at right angles to said South line,
a distance of 30 feet; thence Easterly, parallel to said
South line, to the West line of the said SE 1/4 of Sec-
tion 4; thence continuing Easterly, along a line lying
30 feet North of, if measured at right angles to the
South line of the N 1/2 of the said SE 1/4 of Section
4, to the said West line of Westwood Village and the
Present City Limits Line; thence Southerly, along said
West line and Present City Limits Line, a distance of
10 feet to the Point of Beginning, containing 2.3 acres,
SECTION 2.

Within thirty (30) days after the effective date of the Ordinance the
City Clerk shall:
(a) File one copy of the annexation with the original of this Ordinance
in the office of the City Clerk;
(b) File two certified copies of this Ordinance and annexing map with
the Pueblo County Clerk and Recorder;
(c) File one certified copy of the annexation map and this Ordinance with
the Southeastern Colorado Water Conservancy District.
The City Council hereby consents to the inclusion of the annexed area in
the Southeastern Colorado Water Conservancy District pursuant to C.R.S. §37-
45 -136 (3.6).

This Ordinance shall become effective immediately upon final passage
and the annexation shall be effective for ad valorem tax purposes on and
after January 1, 1992.
