ORDINANCE NO. 5691
AN ORDINANCE APPROVING THE PLAT OF COUNTRY
CLUB VILLAGE SUBDIVISION, 4TH FILING
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that:

The final plat of Country Club Village Subdivision, 4th Filing,
being a subdivision of land legally described as follows:
Country Club Village Subdivision Third Filing, according
to the recorded plat thereof recorded February 11, 1981,
being more particularly described as follows:
Beginning at the intersection of the North boundary line
of said Subdivision with the West line of the SW4 of Section
13, Township 20 South, Range 65 West of the 6th Principal
Meridian; Thence along the boundary of said Subdivision,
the following three (3) courses:
1. N 88 -59 -12 E, a distance of 817.00 feet;
2. S 01 -00 -48 E, a distance of 160.00 feet;
3. S 88 -59 -12 W, a distance of 816.68 feet to the West
line of the SW-
thence N 01 -07 -41 W along said west line, a distance of 160.00
feet to the point of beginning, less the West forty (40) feet
thereof, containing 2.85 acres,
SECTION 2.
The acceptance of such dedicated streets, rights -of -way, utility and
drainage easements, public sites, parks and open spaces by the City does not
obligate the City to maintain or repair same until such streets, rights -of -way,
utility and drainage easements, public sites, parks and open spaces have been
constructed and installed in compliance and in accordance with the requirements
and provisions of Chapter 4, Title XII of the 1971 Code of Ordinances, as
amended and any agreement entered into pursuant thereto.

QIIIT CLAIM OF SANITARY SEWER EASEMENT
The undersigned, FEKETE HOMES, INC., a Colorado Corporation
(Grantor), hereby convey and QIIIT CLAIM unto THE CITY OF PUEBLO,
a Municipal Corporation (Grantee), its successors and assigns, for
the consideration of TEN DOLLARS ($10.00) and other good an
valuable consideration, all right, title, interest, claim and
demand which the Grantor may have in and to an easement to
construct, operate and maintain an underground sewer main and all
fixtures and devices used in the operation of said main, through,
under and across the following described land:
The north 20.00 feet of Lot 2 Block 1,
Wills and O'Neal Subdivision Amended,
according to the recorded plat thereof.
Together with the right to enter upon said premises to survey,
construct, maintain, operate, repair, replace, control and use said
sanitary sewer main and related fixtures and devices. Such right
granted by Grantor shall in no event include the right to erect or
cause to be erected any buildings or structures upon the right -of-
way herein granted. In case of abandonment of said right -of -way,
all right, privilege and interest herein granted shall terminate
and revert to Grantor.
The work of installing and maintaining said lines and related
fixtures and devices shall be done with care; the surface along
said right -of -way shall be restored substantially to its level and
condition prior to any installation or maintenance work.
Grantee acknowledges that Parkview Health Systems, Inc., by
previous conveyance reservation, has reserved the right to use the
above - described property for purposes not inconsistent with the
rights granted herein.
This easement shall run with the land and be binding upon and
inure to the benefit of the Grantee and the Grantor and their
respective heirs, personal representatives, successors and assigns.
The singular includes the plural and the masculine includes the
feminine and neuter.

QUIT CLAIM OF SANITARY SEWER EASEMENT
The undersigned, TOM BLACK, DAVID BLACK, and GREG HAHN
(Grantors) hereby convey and QUIT CLAIM unto THE CITY OF PUEBLO,
COLORADO, a Municipal Corporation (Grantee) , its successors and
assigns, for the consideration of TEN DOLLARS ($10.00) and other
good an valuable consideration, all right, title, interest, claim
and demand which the Grantors may have in and to an easement to
construct, operate and maintain a sanitary sewer main and all
fixtures and devices used in the operation of said main, through,
under and across the following described land:
A parcel of land being a part of the W 1/2 of the SW 1/4 Section
13, Township 20 South, Range 65 West of the 6th Principal Meridian,
Pueblo County, Colorado, being more particularly described as
follows:
Beginning at the northeast corner of
Country Club Village Subdivision; thence
N 88 °- 59' -12" E, along the south line of
Wills & O'Neal Subdivision Amended, a
distance of 511.66 feet to the northwest
corner of Lot 2, Block 1 of said Wills &
O'Neal Subdivision Amended; thence S 01°-
13'-32" E along the west line of said Lot
2 a distance of 20.00 feet; thence S 88 °-
59'-12" W, a distance of 511.73 feet to the
east line of said Country Club Village
Subdivision; thence N 01 00' -48" W along
said east line a distance of 20.00 feet
to the POINT OF BEGINNING.
Together with the right to enter upon said premises to survey,
construct, maintain, operate, repair, replace, control and use said
sanitary sewer main and related fixtures and devices, and to remove
objects interfering therewith. Such right granted by the Grantors
shall in no event include the right to erect or cause to be erected
any buildings or structures upon the right -of -way herein granted.
In the case of permanent abandonment of said right -of -way, all
right, privilege and interest herein granted shall terminate. The
work of installing and maintaining said lines, related fixtures and
devices shall be done with a minimum of interference to the
surrounding real property, recognizing that the property to the
South of said easement is a part of a golf course facility and will
in the future be utilized as part of the active playing surface of
a golf course. Any interference with the surface by Grantee shall
be restored to the level, slope, and surface condition as it was
immediately prior to the work being performed by Grantee from time
to time.
Grantee acknowledges that the Pueblo County Club, Inc., has,
by reservation in a previous conveyance, reserved the right to use
the above - described property for purposes not inconsistent with the
rights granted herein.
