HomeMy WebLinkAbout06933ORDINANCE NO. 6933 AN ORDINANCE AMENDING CHAPTER 7 OF TITLE VII OF THE PUEBLO MUNICIPAL CODE RELATING TO SOLID WASTE SERVICE CHARGES BY INCLUDING SOLID WASTE TRANSFER STATIONS BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (Brackets indicate matter being deleted; underscoring indicates new matter being added) SECTION 1 The City Council does hereby find and determine that the imposition and collection of solid waste service charges from the users of solid waste transfer stations by the operators thereof for the purpose of financing solid waste management within the City will promote the public health, safety and welfare. SECTION 2 Subsections (a), (b) and (c) of Section 1 of Chapter 7 of Title VII of the Pueblo Municipal Code are amended to read as follows: u "Certificate of designation" means a certificate to operate a solid waste disposal site and facility issued pursuant to Chapter 12 of Title IV of this Code. (b) "Facility' means and includes both a solid waste disposal site and facility for which a certificate of designation has issued and a solid waste transfer station (c) "Operator' means the person who [has been issued a certificate of designation to operate] owns or operates a facility. SECTION 3 Section 1 of Chapter 7 of Title VII of the Pueblo Municipal Code is amended by the addition of the following new subsection (f): fn "Solid waste transfer station" means a location, structure or building at which solid waste awaiting transportation to a disposal site, is transferred from one type of containerized collection receptacle and placed into another or is processed for compaction. SECTION 4 If any provision of this Ordinance shall be determined to be invalid or unenforceable, such determination shall not affect any other provision of this Ordinance or render same invalid or unenforceable. SECTION 5 This Ordinance shall become effective upon final approval and passage.
