ORDINANCE NO. 5625
AN ORDINANCE CALLING A SPECIAL MUNICIPAL ELECTION
TO BE HELD ON NOVEMBER 6, 1990, REFERRING ORDI-
NANCE NO. 5592 RELATING TO SALES AND USE TAX TO A
VOTE OF THE REGISTERED ELECTORS OF THE CITY OF
PUEBLO AT SUCH SPECIAL MUNICIPAL ELECTION, AND
PROVIDING FOR ELECTION PROCEDURES AND OTHER
MATTERS RELATING THERETO
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that:

A special municipal election is hereby called under Article
18 of the Charter of the City of Pueblo for Tuesday, November 6,
1990 to be held in conjunction with and at the same time and in
the same manner as the General Election to be held on that date.

There is hereby submitted to a vote of the registered
electors of the City of Pueblo at the special municipal election
proposed Ordinance No. 5592, a copy of which is attached hereto
and incorporated herein as if set out herein in full. The ballot
proposal submitted to a vote of the registered electors shall be
in substantially the following form:
" SALES AND USE TAX
Should Ordinance No. 5592 amending the City's
sales and use tax ordinances to impose a one
percent increase in the sales and use tax rate
from three percent to four percent for the
period January 1, 1992 through December 31,
1998, to dedicate the revenues from such one
percent increase in the sales and use tax rate
for the following municipal purposes and
activities as determined by the City Council:
lawful economic development and job- creation
within the City and Pueblo Memorial Airport -
50 %, capital improvements and projects - 38 %,
equipment - 7 %, and beautification and urban
enhancement - 5 %, to create a special fund and
accounts for the deposit of the revenues
therefrom, to authorize the issuance of revenue
bonds payable solely from such special fund and
accounts, and to determine that the appropria-
tion and expenditure of revenues for economic
development and job- creation are public purposes
and municipal functions be approved ?"
(any registered elector of the City of Pueblo
desiring to vote on the above proposal shall
indicate his or her vote by punching the ballot
card where indicated "FOR THE ORDINANCE" or
"AGAINST THE ORDINANCE ")
SECTION 3
The special municipal election hereby called shall be held
and conducted during the same hours, at the same polling places,
and in the same manner as the General Election. The special
municipal election shall be held and conducted by the same
election officials who act in like capacity and perform like
functions for the General Election. The City Clerk and Board of
Elections shall cooperate with the County Clerk and Recorder of
Pueblo County, Colorado and the election officials for the General
Election and shall perform such functions and duties relating to
the holding and conduct of the special municipal election as may
be required of them by the Charter and Ordinances of the City of
Pueblo. The City Clerk shall make publication and give notice in
respect to the submission of the proposal to the electors at the
special municipal election at the same time and in the same manner
as a general municipal election.
SECTION 4
The City Council does hereby designate and appoint and does
hereby authorize and direct the City Clerk and the Board of
Elections to designate and appoint as judges and clerks for the
MVM
special municipal election to be held November 6, 1990, the same
persons designated and appointed by the County Clerk and Recorder
of Pueblo County, Colorado as judges and clerks for the General
Election to be held on November 6, 1990.
The City Council does hereby adopt the optional registration
plan provided for in Section 17 -9 of the Charter and as set forth
in the City's Municipal Election Code and hereby determines and
declares that voting machines are not available and all votes at
the special municipal election shall be taken, recorded and
tabulated by use of an electronic voting system.
SECTION 6.
All ordinances, including the Pueblo Election Code,
resolutions, rules, regulations or bylaws, or parts thereof,
inconsistent with this Ordinance or any provision hereof are
superseded and suspended by the conflicting provisions of this
Ordinance for and during the time the special municipal election
called hereby is held and conducted.
