HomeMy WebLinkAbout05619Reception 927938 08/07/1990 ORDINANCE NO. 5619 AN ORDINANCE ANNEXING THE AREA COMMONLY KNOWN AND DESCRIBED AS THE DESIGNATED SOUTH LANDFILL, ALL OF HIGHWAY 78 WEST TO HOG RANCH ROAD AND ALL OF HOG RANCH ROAD WHEREAS, the City Planning and Zoning Commission has recommended that the area described in Section 1 hereof be annexed to the City of Pueblo; and WHEREAS, the City Council has heretofore found and determined by Reso- lution that the Petition For Annexation and the area described in Section 1 hereof to be in compliance with the notice and other applicable provisions of the Municipal Annexation Act of 1965 and C.R.S. §31 - - 104, 105 and 107(1); and WHEREAS, the City Council has by Resolution found and determined that an election is not required under C.R.S. §31 -12- 107(2) and no additional terms and conditions are to be imposed upon the area described in Section 1 other than those set forth in the Petition For Annexation; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1. The following described area situated in Pueblo County, Colorado, is hereby annexed to Pueblo, a Municipal Corporation, subject to the terms and conditions set forth in the Petition For Annexation, and the official map of the City shall be amended to show such annexation: BOOK2510 PA F591 AREA N0. 1: portion of the Right -of -Way of Colorado State High- way No. 78 in the S2 of Section 9, Township 21 South, Range 65 West of the 6th P.M., being portions of Blocks 11, 12, 18, 19, 23, 24, 26, 27, 34, 35 and 36 and the vacated streets and alleys adjacent thereto in Columbia Heights, according to the recorded plat thereof, filed for record May 23, 1888, in Plat Book 4 at Page 4 of the Pueblo County Records and being portions of Lots 19 and 20, Block 8 and Lots 1 and 11, Block 12 and the vacated streets adjacent thereto in Shull's Subdivision, of the SW4 of Section 9, Twp. 21 South, Range 64 West, according to the recorded plat thereof, filed for record July 14, 1887 in Plat Book 2A at Page 43 of said County Records and being more parti- cularly described as follows: Beginning at a point on the Present City Limits Line, said point being the interesection of the Northerly Right -of -Way line of said Colorado State Highway No. 78 and the South line of said Section 9; thence North- easterly, along said Northerly Right-of -Way line to the centerline of vacated Holden Avenue, as platted in said Columbia Heights and being a point on the present City Limits Line; thence along the present City Limits Line the following three (3) courses: 1. Southeasterly, at right angles to the said Northerly Right -of Way line, to the Southerly Right -of -Way line of said Colorado State Highway No. 78; 2. Southwesterly, along said Southerly Right -of -Way line, to the said South line of Section 9; 3. Westerly, along said South line to the Point of Beginning. At least one -sixth of the boundary of the land described above is Existing City Limits Line. AREA N0. 2: portion of the Right -of -Way of Colorado State Highway No. 78 in the NW- of Section 16, in the NE4, SE4 and SW'- of Section 17, in the NE4 of Section 19 and in the NW- of Section 20, Township 21 South, Range 65 West of the 6th P.M. and being more particularly described as follows: Beginning at a point on the Present City Limits Line, said point being the intersection of the Southerly Right -of -Way line of said Colorado State Highway No. 78 and the Easterly line of the Arkansas Valley Conduit; thence Southwesterly, along the said Southerly Right -of -Way line and along the Present City Limits Line, to the Northeast corner of Lot 1, Block 1 in Westmoor Estates, according to the recorded plat thereof, filed for record January 6, 1959 in Plat Book 13 at Page 247 of the Pueblo County Records; thence contin- uing Southwesterly, along the said Southerly Right -of -Way line of Colorado State Highway No. 78, to the West line of the said NE4 of Section 19; thence Northerly, along said West line, to the centerline of said Colorado State Highway -2- DOCK 2510 PA;E 592 No. 78; thence Northwesterly, along said Centerline, to the Easterly line of the Arkansas Valley Conduit; thence South- easterly, along said Easterly line to the Point of Beginning. At Least one -sixth of the Boundary of land described above is Existing City Limits Line. AREA N0. 3: portion of the Right -of -Way of Colorado State Highway No. 78 in the NW- of Section 16, in the NE4, SE4 and SW4 of Section 17, in the NE4, NW- and SW4 of Section 19 and in the NW4 of Section 20, Township 21 South, Range 65 West of the 6th P.M. AND A portion of the East 60 feet of the W2 of the W2 of Section 19, Township 21 South, Range 65 West of the 6th P.M. AND All of the SW4, the S2 of the NW4 and the N2 of the SE4 of Section 18, Township 21 South, Range 65 West of the 6th P.M. AND The East 600 feet of the South 335 feet of the NE4 and the East 600 feet of the SE4 of Section 13, Township 21 South, Range 65 West of the 6th P.M. and being more particularly described as follows: Beginning at a point on the Present City Limits Line, said point being the intersection of the centerline of the Right -of- Way of said Colorado State Highway No. 78 and the Easterly line of the Arkansas Valley Conduit; thence Northwesterly, along said Easterly line to the Northerly Right -of -Way line of said Colorado State Highway No. 78; thence Southwesterly, along said Northerly Right -of -Way line to the Northeasterly line of a tract of land conveyed to the Colorado Department of Highways by deed recorded in Book 1264 at Page 289 of the Pueblo County Records; thence Northwesterly, along said Northeasterly line to the East line of the W2 of the W2 of said Section 19; thence Northerly, along said East line to the South line of the SW- of said Section 18; thence Easterly, along said South line to the S% corner of said Section 18; thence Northerly, along the East line of the said SW- to the Southwest corner of the N2 of the SE4 of said Section 18; thence Easterly, along the South line of the said NZ of the SE- to the East line of the said SE- thence Northerly, along said East line to the E4 corner of said Section 18; thence Westerly, along the North line of the said SE4 to the C4 corner of said Section 18; thence Northerly, along the East line of the NW-4 of said Section 18 to the Northeast corner of the S2 of the said NW- thence Westerly, along the North line of the said S2 of the NW- to the West line of the said NW4; thence Southerly, along said West line to the Northeast corner of the South 335 feet of the NE- of said Section 13; thence Westerly along the North line of the said South -3- noK 2510 PAGE 593 335 feet of the NE- a distance of 600 feet; thence Southerly, along the West line of the East 600 feet of the said NE4 to the North line of the SE- of said Section 13; thence Southerly, along the West line of the East 600 feet of the said SE- to the South line of said SE- thence Easterly, along said South line to the Southwest corner of said Section 18; thence Easterly, along the South line of the SW'- of said Section 18 to the Northwest corner of the East 60 feet of the W2 of the W4 of said Section 19; thence Southerly, along the West line of said East 60 feet to the Southwesterly line extended of the said tract of land conveyed to the Colorado State Depart- ment of Highways by deed recorded in Book 1264 at Page 289; thence Southeasterly, along said Southwesterly line and that line extended to the Southerly Right -of -Way line of said Colorado State Highway No. 78; thence Northeasterly, along said Southerly Right -of -Way line to the East line of the NW4 of said Section 19; thence Northerly, along said East line to the centerline of the Right -of -Way of said Colorado State Highway No. 78; thence Northeasterly, along said centerline to the point of beginning. At least one -sixth of the boundary of the land described above is Existing City Limits Line. QVOTTMI 9 Within thirty (30) days after the effective date of the Ordinance the City Clerk shall: (a) File one copy of the annexation with the original of this Ordinance in the office of the City Clerk. (b) File two certified copies of this Ordinance and annexing map with the Pueblo County Clerk and Recorder. (c) File one certified copy of the annexation map and this Ordinance with the Southeastern Colorado Water Conservancy District. SECTION 3. The City Council hereby consents to the inclusion of the annexed area in the Southeastern Colorado Water Conservancy District pursuant to C.R.S. §37- 45 -136 (3.6).
