HomeMy WebLinkAbout05602ORDINANCE N0. 5602 AN ORDINANCE AMENDING SECTIONS OF CHAPTER 5, TITLE IV OF THE 1971 CODE OF ORDINANCES OF THE CITY OF PUEBLO RELATING TO BUILDING REGULATIONS, HEATING, VENTILATING, COOLING, REFRIGERATION SYSTEMS; ADOPTING BY REFERENCE THERETO THE UNIFORM MECHANICAL CODE, 1988 EDITION, WITH THE 1989 SUPPLEMENT, PROMULGATED AND PUBLISHED BY THE INTERNATIONAL CONFERENCE OF BUILDING OFFICIALS, 5360 SOUTH WORKMAN MILL ROAD, WHITTIER, CALIFORNIA 90601; PROVIDING FOR A PENALTY FOR VIOLATIONS OF THE PROVISIONS OF SAID CODE; AND PROVIDING FOR A PUBLIC HEARING IN RELATION THERETO BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, THAT: (Brackets indicate material being deleted; underscoring indicates material being added). SECTION 1. Section 1, Chapter 5, Title IV of the 1971 Code of Ordinances is hereby amended to read as follows: 4 -5 -1: UNIFORM MECHANICAL CODE - ADOPTION BY REFERENCE The Uniform Mechanical Code, [1985] 1988 Edition, including all appendices, promulgated and published by the International Conference of Building Officials, 5360 South Workman Mill Road, Whittier, California 90601, and the International Association of Plumbing and Mechanical Officials, 20001 South Walnut Drive, Walnut, California 91789 [herein] referred to as the Uniform Mechanical Code or U.M.C., as amended by this Chapter and subsequent U.M.C. supplements, is [hereby] adopted and enacted by reference [and made a part hereof as if set out herein in full;] provided, however, [that] the following portions of the U.M.C. are not adopted and are expressly deleted: Section 304(b), (c), and (e); Table No. 3 -A, pages [22 and 23] 12 and 13 relating to Mechanical Permit Fees; Section 804, on page [66] 56 entitled "Floor Furnaces "; Section 1008, being pages [93 and 941 84 and 85 entitled "Use of Underfloor Space as Supply Plenum "[; and No. 6 -A, on page 54]. Copies of this Code are available in the office of the Pueblo Regional Building Department for distribution and sale to the public[ at a price not to exceed actual cost to the City, plus a handling charge of One Dollar and Seventy -five cents ($1.75) per copy]. The regulation, design, control, construction, installation, quality of materials, location, operation, alteration, repair and maintenance of heating, ventilating, cooling, refrigeration systems, incinerators and other miscellaneous heat - producing appliances or parts thereof within the City of Pueblo shall be in compliance with the terms and provisions of this Chapter and the Uniform Mechanical Code, [1985] 1988 Edition, [herein adopted by reference,] except as same may be excluded from and specifically not covered by this Chapter and [said] the Uniform Mechanical Code. SECTION 2. Section 2, with the exception of Tables 1, 2, and 3, Chapter 5, Title IV of the 1971 Code of Ordinances is [hereby] amended to read as follows: (Tables 1, 2, and 3 of Section 2 shall remain unchanged) 4 -5 -2: AMENDMENTS (1) Section 201(a) of the U.M.C. is [hereby] amended to read as follows: Powers and Duties of Building Official -2- Section 201(a) General. The building official is [hereby] authorized and directed to enforce [all] the provisions of this code. This code shall be under the jurisdiction of the Pueblo Regional Building Department. The Chief Mechanical Inspector or in his absence the building official whose duties and responsibilities are set forth in Title IV of the 1971 Code of Ordinances shall enforce the provisions of this code. (2) Section 201(b) of the U.M.C. is [hereby] amended to read as follows: Sec. (b) Deputies: Whenever the term "authorized representatives" appears it shall be construed to refer to "Regional Building Department Mechanical Inspectors." (3) Section 204 of the U.M.C. is [hereby] amended by the addition of the following paragraph: Any person, firm or corporation violating any of the provisions of this code or said Chapter 5 shall upon conviction thereof be punished as provided in Section 1 -2 -1 of the 1971 Code of Ordinances of Pueblo. (4) Section 302 of the U.M.C. is [hereby] amended by the addition of the following new subsection (d): (d) No permit required by this code shall be issued by the Pueblo Regional Building Department to any person unless such person is duly licensed or certified as provided in Title IV of Chapter 3 of the Code of Ordinances of the City of Pueblo. (5) Section 304(a) of the U.M.C. is [hereby] amended to read as follows: Section 304(a) Permit Fees. The fee for each permit -3- shall be paid to the Pueblo Regional Building Department as set forth by resolution of the City Council. (6) Section 502 of the U.M.C. is [hereby] amended by the addition of the following: No open face circulating heater or gaslog type heater shall be [hereafter] installed in the City unless they have been approved by Underwriters Laboratories and American Gas Association or other recognized approved agencies Before a furnace or boiler is given final approval, all controls and wiring shall be complete[,] and the controls shall be connected and in operation. Cold and warm air ducts shall be completely installed. All log lighters [hereinafter] installed shall be equipped with an approved timer. (7) Section 709 -3 of the U.M.C. is [hereby] amended by the addition of the following: and shall be connected with an approved listed metal appliance connector. (8) Section 803 -4 of the U.M.C. is [hereby] amended by the [deletion of the second paragraph] addition of the following All gas logs shall be equipped with a pilot. (9) Section 804 of the U.M.C. is [hereby] amended to read as follows: Sec. 804 Floor Furnaces. All floor furnaces are banned. (15) Section 2004(b) of the U.M.C. is [hereby] amended by the addition of the following paragraph: A readily accessible means to manually activate a fire extinguishing system, except a sprinkler system, shall be provided -4- in a path of exit or egress and shall be clearly identified. The operation of any extinguishing system shall automatically shut off all sources of fuel and heat to all equipment protected by an extinguishing system or located under ventilating equipment protected by an extinguishing system. Automatic valves or cut -off devices shall be readily accessible for resetting or replacement. (16) Subsection (a) of Section 2107 of the U.M.C. is [hereby] amended by the addition of the following: A vacuum breaker approved for such use, shall be installed at the cold water fill line to prevent backflow into the potable water system. (17) Section 2109 of the U.M.C. is [hereby] amended by the addition of the following: Approved main burner safety shut off valves shall be required on all boilers where the burner input is in excess of 400,000 B.T.U. An additional spring loaded type solenoid gas valve or hydromotor type gas valve shall be installed when a diaphragm type gas valve is installed. Any change in existing safety shut -off valves will require compliance with this section. (18) Section 2213(c) Drip Pipes is [hereby] deleted. (19) Section 2219 of the U.M.C. is [hereby] amended by the addition of the following new subsection (d): (d) Required Gas Piping Size. Gas Utilization Standards for house piping shall be as follows: (20) The U.M.C. is [hereby] amended by the addition of the following new Chapter [23]25: -5- CHAPTER [23]25 STORAGE WATER HEATERS Section [2301] General. In addition to the general requirements of Chapter 5 of the U.M.C., every water heater shall be installed to conform to the requirements of this Chapter. Section [2302] Permits. It shall be unlawful for any person to install, remove or replace any water heater without first obtaining a permit from the [Inspection Division] Pueblo Regional Building Department to do so. Section [2303] Installation Requirements. Proper provisions shall be made for an adequate supply of air for combustion and ventilation as specified in Chapter 6 of the U.M.C. Insulated gas -fired domestic water heaters shall be provided with, in addition to the primary temperature controls, an over temperature safety relief valve, listed and installed in accordance with recognized standards. Every water heater designed to be vented shall be connected to such system and shall comply with provisions specified in Chapter 9 of the U.M.C. Section [2304]2504. [No water heater shall be installed in any room used or designed to be used for sleeping purposes, bathroom, or in any confined space opening into a bathroom or bedroom, residential garage, or under any stairway.] All water heater installations shall comply with section 704 of the U.M.C. EXCEPTION: Replacement of existing water heaters shall be by approval of the [building official only] chief mechanical inspector =:fl Section [2305] All water heaters located in underfloor spaces shall be installed as per Section 709. SECTION 3. The caption of Chapter 5, Title IV of the 1971 Code of Ordinances is [hereby] amended to read "Mechanical Installations" instead of "Gas Installations." SECTION 4 The purpose of the Uniform Mechanical Code is to safeguard the public health, safety, property, and welfare by regulating and controlling the design, construction, quality of materials, use, occupancy, location, alteration, maintenance and repair of all buildings and structures within the City of Pueblo. SECTION 5 A public hearing to consider the adoption by reference of the Uniform Mechanical Code, 1988 Edition, shall be held in the Council Chambers, City Hall, Pueblo, Colorado, at 7:30 p.m. on June 11, 1990. The City Clerk is directed to publish notice of such hearing pursuant to Section 31 -16 -203 of the Colorado Revised Statutes. CFr"TTnM G Non - liability. The adoption of this ordinance and of the Uniform Mechanical Code shall not create any duty to any person, firm, corporation, or other entity with regard to the enforcement or nonenforcement of this ordinance or said code. No person, firm, corporation, or other entity shall have any private right of action, claim or civil liability remedy against the City of Pueblo or the Pueblo Regional Building Department, or their officers, employees or agents, for any damage arising out of or in any way -7- connected with the adoption, enforcement, or nonenforcement of this ordinance or said code. Nothing in this ordinance or in said code shall be construed to create any liability, or to waive any of the immunities, limitations on liability, or other provisions of the governmental Immunity Act, C.R.S. X24 -10 -101 et seq., or to waive any immunities or limitations on liability otherwise available to the City of Pueblo or the Pueblo Regional Building Department, or their officers, employees or agents. SECTION 7 If any part, section, subsection, sentence, clause or phrase of this Ordinance, the Uniform Mechanical Code or the minor adopted hereby is for any reason held to be invalid, such decision shall neither affect the validity of the remaining portions of this Ordinance, the Uniform Mechanical Code or the minor codes.
