HomeMy WebLinkAbout05598Reception 923767 06/22/1990 ORDINANCE NO. 5598 AN ORDINANCE ANNEXING THE AREA COMMONLY KNOWN AND DESCRIBED AS PUEBLO MEMORIAL AIRPORT NO. 2 - ALL OF THE RUNWAYS WHEREAS, the City Planning and Zoning Commission has recommended that the area described in Section 1 hereof be annexed to the City of Pueblo; and WHEREAS, the City Council has heretofore found and determined by Reso- lution that the Petition For Annexation and the area described in Section 1 hereof to be in compliance with the notice and other applicable provisions of the Municipal Annexation Act of 1965 and C.R.S. §31 -13 -104, 105 and 107(1); and WHEREAS, the City Council has by Resolution found and determined that an election is not required under C.R.S. §31 -12- 107(2) and no additional terms and conditions are to be imposed upon the area described in Section 1 other than those set forth in the Petition For Annexation; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1. The following described area situate in Pueblo County, Colorado, is hereby annexed to Pueblo, a Municipal Corporation, subject to the terms and conditions set forth in the Petition For Annexation, and the official map of the City shall be amended to show such annexation: BOOK 2504 PAP 142 PARCEL A A parcel of land located within the County of Pueblo, State of Colorado, to wit: A parcel of land being a portion of the N 1/2 of Section 25, the N 1/2 of Section 26, and all of the S 1/2 of the S 1/2 of Section 23 and all of Section 24, Township 20 South, Range 64 West and being a portion of Section 19, the S 1/2 of the S 1/2 of Section 20, the N 1/2 of Section 29 and the N 1/2 of Section 30, Township 20 South, Range 63 West of the Sixth Principal Meridian being more particularly described as follows: Being at a point on the west line of the NW 1/4 of said Section 26; Thence N 00 -41 -33 W., along the said west line, a distance of 1289.44 feet to the NW corner of said Section 26; Thence northerly along the west line of the SW 1/4 of said Section 23 to the NW corner of the SW 1/4 of the SW 1/4 of said Section 23; Thence easterly along the north line of the S 1/2 of the S 1/2 of said Section 23 to the NE corner of the SE 1/4 of the SE 1/4 of said Section 23; Thence northerly along the west line of said Section 24 to the NW corner of said Section 24; Thence easterly along the north line of said Section 24 to the NE corner of said Section 24; Thence S 44 -22 -12 E., a distance of 1847.36 feet to the NE corner of the SW 1/4 of the NW 1/4 of said Section 19; Thence S 45 -08 -42 E., a distance of 3744.61 feet to the NW corner of the SE 1/4 of the SE 1/4 of said Section 19; Thence easterly along the north line of the said SE 1/4 of the SE 1/4 of Section 19 to the NE corner of the said SE 1/4 of the SE 1/4 of Section 19; thence easterly long the north line of the said S 1/2 of the S 1/2 of Section 20 to the NE corner of the SE 1/4 of the SE 1/4 of said Section 20; Thence southerly along the east line of the said SE 1/4 of the SE 1/4 of Section 20 to the SE corner of Section 20; Thence S 00 -02 -28 E., along the east line of the NE 1/4 of the NE 1/4 of said Section 29 a distance of 1206.24 feet; Thence S 88 -25 -39 W, a distance of 13,248.18 feet; Thence N 01 -31 -15 W., a distance of 27.11 feet; Thence S 89 -00 -26 W., a distance of 2329.44 feet; Thence S 88 -25 -39 W, a distance of 5120.29 feet; Thence along the arc of a non - tangent curve to the left whose centers bears S 22 -49 -37 W., and whose radius is 1075 feet, a distance of 162.15 feet; Thence N 00 -41 -33 W., a distance of 522.09 feet; Thence S 89 -18 -27 W., a distance of 435.00 feet to the point of Beginning. Said parcel contains 2,056 acres more or less. CPA BOOK 2504 PAF,E U PARCEL B A parcel of land located within the County of Pueblo, State of Colorado, to wit: A parcel of land being a portion of the S 1/2 of Section 13, Township 20 South, Range 64 West of the Sixth Principal Meridian being more particulary described as follows: Beginning at the SW corner of said Section 13; Thence northerly along the west line of the SW 1/4 of said Section 13 to the NW corner of the SW 1/4 of said Section 13; Thence easterly along the north line of the S 1/2 of said Section 13, a distance of 4293.03 feet; Thence S 01 -31 -45 E., a distance of 1537.44 feet; Thence S 44 -22 -12 E., a distance of 1565.68 feet to the SE corner of said Section 13; Thence westerly along the south line of said Section 13 to the Point of Beginning. Said parcel contains 277 acres more or less. SECTION 2. Within thirty (30) days after the effective date of the Ordinance the City Clerk shall: (a) File one copy of the annexation with the original of this Ordinance in the office of the City Clerk. (b) File two certified copies of this Ordinance and annexing map with the Pueblo County Clerk and Recorder. (c) File one certified copy of the annexation map and this Ordinance with the Southeastern Colorado Water Conservancy District. SECTION 3. The City Council hereby consents to the inclusion of the annexed area in the Southeastern Colorado Water Conservancy District pursuant to C.R.S. §37- 45 -136 (3.6). gV0TTnT,T A This Ordinance shall become effective immediately upon final passage and the annexation shall be effective for ad valorem tax purposes on and after January 1, 1991. -3- BOOK 2504 PA 144 INTRODUCED May 29 , 1990 By KENNETH HUNTER Councilperson APPROVED AA 01111.
