HomeMy WebLinkAbout05588Reception 9174183 03/22/1990 ORDINANCE N0. 5588 AN ORDINANCE ANNEXING THE AR7;.� COMMONLY KNOWN AND DESCRIBED AS THE WASTE WATER TRFATMENT PLANT - CORNER OF QUEENS AVENUE AND STOCK YARD ROAD WHEREAS, the City Planning and Zoning Commission has recommended that the area described in Section 1 hereof be annexed to the City of Pueblo; and WHEREAS, the City Council has heretofore found and determined by Reso- tion that the Petititon For Annexation and the area described in Section 1 hereof to be in compliance with the notice and other applicable provisions of the Municipal Annexation Act of 1965 and C.R.S. §31 -13 -104, 105 and 107(1); and WHEREAS, the _City Council has by Resolution found and determined that an election is not required under C.R.S. §31 -12- 107(2) and no additional terms and conditions are to be imposed upon the area described in Section 1 other than those set forth in the Petition For Annexation: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION L The following described area situated in Pueblo County, Colorado, is hereby annexed to Pueblo, a Municipal Corporation, subject to the terms and conditions set forth in the Petition For Annexation, and the official map of the City shall be amended to show such annexation: boos 2490 PA1.157 AREA NO. 1: A portion of Lots 12, 13 and 14 in Lamborn Subdivision of a portion of Lot 1, Sec. 6, Twp. 21 South, Range 64 West, Pueblo County, Colorado, according to the recorded plat thereof, filed for record November 24, 1902 in Book 9 at Page 29 of the Pueblo County Records AND A portion of Lot 1 (North of the Arkansas River) and the NEh of Section 6 and a portion of Lots 4 and 5 (North of the Arkansas River) and the NW-4 of Section 5, Township 21 South, Range 64 West of the 6th P.M. AND A portion of the Right -of -Way of Colorado State Highway No. 227, and being more particularly described as follows: Commencing at a point on the Present City Limits Line, said point being the Northwest corner of Lot 12 in said Lamborn Subdivison; thence Easterly, along the North line of said Lot 12 and along the said Present City Limits Line, a distance of 75 feet to the True Point of Beginning; thence Easterly, along said North Line and that line extended to the East Right -of -Way line of Colorado State High- way No. 227; thence Southerly, along said East Right -of -Way line to the Westernmost corner of a tract of land as described in Book 2348 at Page 274 of the Pueblo County Records; thence Easterly and Souther- ly, along the West line of said tract of land to the Southwest corner thereof; thence Easterly, along the South line of tract of -land and along the South line of a tract of land as described in Book 1026 at Page 463 of the said County Records to the East line extended of the Westerly tract of land as described in Book 1667 at Page 612 of said County Records; thence Southerly, along said East line extended to the centerline of the Right -of -Way of Booth - Orchard Grove Ditch as described in Book 1746 at Page 894 of said County Records; thence Southwesterly, along said centerline to the centerline of the Booth Ditch Headgate; thence Southerly, a distance of 15 feet to the Westernmost corner of said Westerly tract of land described in Book 1667 at Page 612; thence South- easterly, along the South line of said Westerly tract of land to the Southeast corner thereof; thence Southwesterly, along the East line extended of said Westerly tract of land to a line lying 50 feet North of, if measured at right angles to, the centerline of the Arkansas River; thence Northwesterly, along said line to the West line extended of said Lot 12 in Lamborn Subdivision; then North, along said West line extended to the North bank of the Arkansas River and the Present City Limits Line; thence Easterly and Northerly, along said Present City Limits Line to the Point of Beginning. At least one -sixth of the boundary of the land described above is Existing City Limits Line. -2- b0OK2490 f)Aj.E15S AREA NO. 2: A portion of the NE4 of Section 6 and a portion of Lot 5 (North of the Arkansas River) and the NWT of Section 5, Township 21 South, Range 64 West of the 6th P.M. AND A portion of the Right -of -Way of Colorado State Highway No. 227, and being more particularly described as follows: Beginning at a point on the Present City Limits Line, said point being the Southwest corner of the Easterly tract of land as described in Book 1667 at Page 612 of the Pueblo County Records; thence Easterly, along the South line of said Easterly tract of land to the Southeast corner thereof; thence Northerly, along the East line of said Easterly tract of land and that line extended to the centerline of the Right -of -Way of the Booth - Orchard Grove Ditch as described in Book 1746 at Page 894 of the said County Records; thence Easterly, along said centerline to the East line extended of the tract of land described in Book 1026 at Page 463 of said County Records;. Northerly, along said East line and that line extended to the Northeast corner of said tract of land; thence Westerly, along the North line of said tract of land to the Southeast corner of a tract of land as described in Book 1661 at Page 242 of the said County Records; thence Northerly, along the East line of said tract of land to the North line of said Lot 5 (North of- the._Arkansas River); thence Easterly, along said North line to the Northeast corner of said Lot 5; thence Southerly, along the East line of said Lot 5 and along the agreement line between Lots 5 and 6 in said Section 5, as described in Book 1595 at Page 447 of the said County Records to the centerline of the Arkansas River; thence Northwesterly, along said centerline to the West line extended of Lot 12 in Lamborn Subdivision of a portion of Lot 1, Sec. 6, Twp. 21 South, Range 64 West, Pueblo County, Colorado, according to the recorded plat thereof, filed for record November 24, 1902 in Book 9 at Page 29 of the said County Records; thence North, along said West line extended to a line lying 50 feet North of, if measured at right angles to, the centerline of the Arkansas River; thence Southeasterly, along said line to the West line extended of the said Easterly tract of land, described in Book 1667 at Page 612; thence Northerly, along said West line extended to the Point of Begin- ning. At least one -sixth of the boundary of the land described above is Existing City Limits Line. -3- PA,E J59 AREA N0. 3: A portion of Lot 3 and all of Lot 4 in Academy of Natural Sciences Subdivision, according to the recorded plat thereof, filed for record March 21, 1921, in Book 11 at Page 28 of the Pueblo County Records AND That portion of Parcel "A" in Lot Line Rearrangement No. 12, according to the recorded plat thereof, filed for record December 7, 1989 in Book 2475 at Page 13 of the said County Records, being the W of Lot 2 (North of the Arkansas River) in the NE4 of Sec= tion 5, Township 21 South, Range 64 West of the 6th P.M., and being more particularly described as follows: Beginning at a point on the Present City Limits Line, said point being the Southeast corner Lot 4 in said Academy of Natural Sciences Subdivision; thence Westerly, along the South line of said Subdivision and along the said Present City Limits Line to the Northeast corner of a tract of land, as described in Book 1661 at Page 242 of the Pueblo County Records; thence continuing Westerly, along said South line to the Southwest corner of Lot 3 in said Subdivision; thence Northerly, along the West line of said Lot 3 to the Northwest corner of a tract of land, as described in Book 882 at Page 69 of the said County Records; thence Easterly, along the North line of said tract of land to the West line of said Lot 4; thence Northerly, along the West line of said Lot 4 to the Northwest corner thereof; thence Easterly, along the North line of said Lot 4 to the West line of said Parcel "A "; thence Northerly along said West line to the Northwest corner of said Parcel "A "; thence Easterly, along the North line of said Parcel "A" to the East line of the W of said Lot 2 (North of the Arkansas River); thence Southerly, along said East line to the South line of said Lot 2; thence Westerly, along said South line to the Point of Beginning. At least one -sixth of the boundary of the land described above is Existing City Limits Line. -4- BOOK 2490 WrE lbo AREA NO. 4: Parcel " A " in Lot Line Rearrangement No. 12, accord- ing to the recorded plat thereof, filed for record December 7, 1989, in Book 2475 at Page 13 of the Pueblo County Records EXCEPT That portion thereof being the W2 of Lot 2 (North of the Arkansas River) in the NE% of Section 5, Township 21 South, Range 64 West of the 6th P.M. and being more particularly described as follows: Beginning at a point on the Present City Limits Line, said point being the Southwest corner of said Parcel "A "; thence along the said Present City Limits Line the following three (3) courses: 1) Northerly, along the West line of said Parcel "A" to the South- west corner of said Lot 2 (North of the Arkansas River); 2) Easterly, along the South line of said Lot 2 to the East line of the W2 of said Lot 2; 3) Northerly, along said East line to the North line of said Parcel "A "; thence Easterly, Southerly and Westerly, along the boundary of said Parcel "A" to the Point of Beginning. At least one -sixth of the boundary of the land described above is Existing City Limits Line. Said Parcels contain 109 acres, more or less. SECTION 2. Within thirty (30) days after the effective date of the Ordinance the City Clerk shall: (a) File one copy of the annexation with the original of this Ordinance in the office of the City Clerk. (b) File two certified copies of this Ordinance and annexing map with the Pueblo County Clerk and Recorder. (c) File one certified copy of the annexation map and this Ordinance with the Southeastern Colorado Water Conservancy District. SECTION 3. The City Council hereby consents to the inclusion of the annexed area in the Southeastern Colorado Water Conservancy District pursuant to C.R.S. §37- 45- 136(3.6). -5- roo , 2490 F,,101 SECTION 4. This Ordinance shall become effective immediately upon final passage and the annexation shall be effective for ad valorem tax purposes on and after January 1, 1991.
