HomeMy WebLinkAbout06924ORDINANCE NO. 6924 AN ORDINANCE GRANTING LIMITED LAW ENFORCEMENT POWERS TO POLICE SUPPORT TECHNICIANS IN THE CITY OF PUEBLO CLASSIFIED SERVICE WHEREAS, enforcement of many provisions of local law can be more efficiently performed by civilian employees with limited law enforcement powers rather than by uniformed police officers with powers of peace officers under state statutes; and WHEREAS, the granting of limited law enforcement powers to such civilian employees requires either an ordinance or a Charter amendment; BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1 Chapter 1 of Title XI of the Code of Ordinances is hereby amended by the addition of a new section 802 to read as follows: 11 -1 -802: Authority of Police Support Technicians. (aa Those civil service employees of the City of Pueblo who have qualified for and been duly appointed to the class of Police Support Technicians are, and shall be deemed to be, duly appointed law enforcement officers of the City of Pueblo authorized by this section to enforce all violations of the Pueblo Municipal Code, including violations of primary and secondary codes adopted thereunder. Such authority shall include, without limitation, the authority to commence a municipal court prosecution of such violations by the issuance and service of a summons and complaint under simplified procedure pursuant to Rule 204, C.M.C.R. Lb) Notwithstanding the provisions of subsection (a) above. Police Support Technicians shall not have any power to arrest beyond the power of citizen's arrest and shall not have the power to carry or use firearms in the performance of their duties. u Police Support Technicians shall act under the supervision and control of the Chief of Police or his designee and shall be trained with respect to the type of conduct or activity which is Prohibited by, and which constitutes a violation of the Pueblo Municipal Code, which they are directed to enforce. SECTION 2 This ordinance shall become effective January 1, 2003.
