HomeMy WebLinkAbout05343•j I/ ORDINANCE NO. 5343 AN ORDINANCE REFERRING ORDINANCE NO. 5314 RELATING TO SALES AND USE TAX TO A VOTE OF THE QUALIFIED ELECTORS OF THE CITY OF PUEBLO AT THE GENERAL ELECTION TO BE HELD ON NOVEMBER 4, 1986 PROVIDING FOR ELECTION PROCEDURES AND OTHER MATTERS RELATING THERETO BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1. A special municipal election is hereby called under Article 18 of the Charter of the City of Pueblo, relating to the referendum, for Tuesday, November 4, 1986 to be held in conjunction with and at the same time and in the same manner as the General Election to be held on that date. SECTION 2. There is hereby submitted to a vote of the qualified registered electors of the City of Pueblo at the special municipal election proposed Ordinance No. 5314, a copy of which is attached hereto and incorporated herein as if set out herein in full. The ballot proposal submitted to a vote of the qualified registered electors shall be in substantially the following form: " SALES AND USE TAX Shall Ordinance No. 5314 amending the City's sales and use tax ordinances to increase the sales and use tax rate by one -half percent from three percent to three and one -half percent for a period of five years and pledging the revenues from such sales and use tax increase for capital improvement purposes at Pueblo Memorial Airport be adopted ?" (any qualified elector of the City of Pueblo desiring to vote on the above proposal shall indicate his or her vote by punching the ballot card where indicated "FOR THE ORDINANCE" or "AGAINST THE ORDINANCE ") SECTION 3 The special municipal election hereby called shall be held and conducted during the same hours, at the same polling places, and in the same manner as the General Election. The special municipal election shall be conducted by the same election officials who act in like capacity and perform like functions for the General Election. The City Clerk and Board of Elections shall cooperate with the County Clerk and Recorder of Pueblo County, Colorado and the election officials for the General Election and shall perform such functions and duties relating to the holding and conduct of the special municipal election as may be required of them by the Charter of the City of Pueblo. The City Clerk shall make publication and give notice in respect to the submission of the proposal to the electors at the special municipal election at the same time and in the same manner as a general municipal election. SECTION 4 The City Council does hereby designate and appoint and does hereby authorize and direct the City Clerk and the Board of Elections to designate and appoint as judges and clerks for the special municipal election be be held November 4, 1986, the same persons designated and appointed by the County Clerk and Recorder of Pueblo County, Colorado as judges and clerks for the General Election to be held on November 4, 1986. SECTION 5 (a) A qualified elector of the City may register in the office of the City Clerk, City Hall, 1 City Hall Place, Pueblo, Colorado, during normal business hours from October 11, 1986, the -2- twenty- fourth day before the special City election to be held on November 4, 1986, through October 21, 1986, the fourteenth day before the special City election. A qualified elector who so registers shall be called a "late registered elector ". (b) There is hereby established for the special City election to be held November 4, 1986, a City -wide polling place for late registered electors at City Hall, 1 City Hall Place, Pueblo, Colorado. All late registered electors shall vote at the City -wide polling place by paper ballot. The conduct of the election at such polling place shall be in the same manner pursuant to the same procedures as a general municipal election except as modified or amended by this Ordinance. The votes cast by late registered electors at the City -wide polling place shall be tabulated and the returns thereof shall be made and certified by the City Clerk to the County Clerk and be incorporated and included with the returns and tabulations of votes cast at the special City election and included in the canvass thereof. The City Clerk shall appoint judges for the City -wide polling place and prepare all election material therefor including paper ballots and absent voters' ballots. (c) A late registered elector may file an application for an absent voter's ballot with the City Clerk not later than the close of business on October 31, 1986, and such absentee ballots must be in the hands of the City Clerk not later than 7:00 o'clock p.m. on the date of the election. The City Clerk and Board of Elections are hereby authorized and empowered to adopt rules and procedures not inconsistent herewith to effectuate and implement the intent and purpose of this Ordinance. Qualified absentee voters and -3- qualified handicapped voters may vote in person as provided in the Colorado Election Code of 1980, except those qualified absentee voters and qualified handicapped voters who are late registered electors must vote at the City -wide polling place as provided in the Pueblo Election Code. SECTION 6. The City Council does hereby adopt the optional registration plan provided for in Section 17 -9 of the Charter and as set forth in the City's Municipal Election Code and hereby determines and declares that voting machines are not available and all votes at the special municipal election shall be taken, recorded and tabulated by use of an electronic voting system except the vote of late registered electors which shall be taken, recorded and tabulated by use of paper ballot. SECTION 7. All ordinances, including the Pueblo Election Code, resolutions, rules, regulations or bylaws, or parts thereof, inconsistent with this Ordinance or any provision hereof are superseded and suspended by the conflicting provisions of this Ordinance for and during the time the special municipal election called hereby is held and conducted.
