HomeMy WebLinkAbout05287l' ORDINANCE NO. 5287 AN ORDINANCE REORGANIZING THE ADMINISTRATIVE DEPARTMENTS OF PUEBLO, A MUNICIPAL CORPORATION; CREATING THE DEPARTMENT OF CONTRACT SERVICES, THE DEPARTMENT OF INFORMATION, THE DEPARTMENT OF PLANNING AND DEVELOPMENT, AND THE DEPARTMENT OF UTILITIES; ORGANIZING AND CREATING THE BUREAU OF PUBLIC WORKS, THE BUREAU OF TRANSPORTATION AND COMMUNITY DEVELOPMENT, AND THE BUREAU OF ADMINISTRATIVE SERVICES; ESTABLISHING DIVISIONS WITHIN THE DEPARTMENT OF PARKS AND RECREATION, THE DEPARTMENT OF PLANNING AND DEVELOPMENT, THE DEPARTMENT OF AVIATION AND TRANSPORTATION, AND THE DEPARTMENT OF HOUSING AND COMMUNITY SERVICES; AND REPEALING ALL ORDINANCES AND RESOLUTIONS IN CONFLICT THEREWITH BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1. Pursuant to Section 3 -12 of the Charter of the City of Pueblo and upon the recommendation of the City Manager, the following Departments are hereby created: (a) The Department of Contract Services, the head of which shall be the Director of Contract Services. The Department shall be responsible for and exercise administrative authority over City contracts, except contracts involving Community Development activities and programs and contracts executed by the City Purchasing Agent, purchases and inventory or real property, franchise monitoring, intergovernmental agreements and such other functions and duties as may be assigned by the City Council. (b) Department of Utilities, the head of which shall be the Director of Utilities. The Department shall be responsible for and exercise administrative authority over sanitary and storm sewer system and wastewater treatment facilities, street lighting, traffic control systems, and demolition. The Department shall cooperate with and assist the Department of Public Works in the management, maintenance and repair of public buildings and perform such other functions and duties as may be assigned by the City Council. (c) The Department of Information, the head of which shall be the Director of Information. The Department shall be respon- sible for the collection and distribution of information on the affairs and activities of the City and such other functions and duties as may be assigned by the City Council. (d) The Department of Planning and Development, the head of which shall be the Director of Planning. The Department shall be responsible for and exercise administrative authority over planning activities for transportation and the physical development of the City and such other functions and duties as may be assigned by the City Council. The Director of Planning and Development shall be the technical adviser of the City Planning and Zoning Commission and shall have such other authority, duties and responsibilities under the direction and control of the Commission as it may require and establish. Pursuant to Sections 3 -12 and 4 -7 of the Charter and upon recommendation of the City Manager, the following Bureaus are hereby organized and established: (a) The Bureau of Administrative Services which shall consist and be composed of the Department of Contract Services, the Department of Data Processing, and the Department of Purchases and Supplies. IWM (b) The Bureau of Public Works which shall consist and be composed of the Department of Public Works and the Department of Utilities. (c) The Bureau of Transportation and Community Development which shall be composed of the Department of Planning and Development, the Department of Zoning, the Department of Aviation and the Department of Transportation. The head of each Bureau shall be a Bureau Chief selected by the City Manager who may be a Director of a Department within such Bureau. The Directors of Departments within a Bureau shall be responsible to the Chief of such Bureau. SECTION 3 Pursuant to Section 4 -8 of the Charter and upon recommenda- tion of the City Manager, the following Divisions within Departments are hereby established: (a) The Department of Parks and Recreation shall consist of a Division of Parks, Division of Recreation, Division of Ice Arena and such other Divisions as may be established by ordinance upon recommendation of the City Manager. (b) The Department of Housing and Community Services shall consist of a Division of Housing, Division of Health and Human Services and other Divisions as may be established by ordinance upon recommendation of the City Manager. (c) The Department of Planning and Development shall consist of a Division of Planning and Development and a Division of Transportation Planning and such other Divisions as may be established by ordinance upon recommendation by the City Manager. -3- (d) The Communication Division is hereby established in the Department of Aviation and Transportation. One or more Divisions in the same Department may be headed by one person. The Director of a Department may serve as the head of any one or more Divisions within the Department. The head of each Division within a Department shall be responsible to the Director of such Department. (a) Ordinance Nos. 5207 and 5209 relating to the reorganization of the administrative departments of the City are hereby repealed. (b) Ordinance No. 3889 creating the Department of Informa- tion is hereby repealed. (c) Ordinance No. 5199 creating the Department of Planning and Development is hereby repealed. (d) The Department of Community Development created by Ordinance No. 4784 is hereby renamed the Department of Housing and Community Services. (e) The Department of Personnel created by Section 8 -1 of the Charter is hereby renamed the Department of Personnel and Training. (f) The functions and duties of the Department of Transportation created by Ordinance No. 3478 are hereby assigned and transferred to the Department of Aviation created by Section 14 -1 of the Charter and the Department of Aviation is hereby renamed the Department of Aviation and Transportation. SECTION 5. -4- In addition to the functions and duties assigned by Charter and Ordinances of the City of Pueblo, the Bureaus, Departments and Divisions of Departments of the City are hereby assigned and delegated the duties and functions set forth in the Functions of City Government which is attached hereto and incorporated herein as if set out herein in full. SECTION 6 If any section or part of this Ordinance shall be adjudged unenforceable or invalid, such judgment shall not affect, impair or invalidate the remaining sections and provisions of this Ordinance, it being the intention that the various provisions hereof are severable. If any section or part of this Ordinance shall conflict with any section or part of the charter of the City, such section or provision shall not be deemed to be invalid but shall to the extent of such conflict be superseded by the conflicting provisions of the Charter which shall prevail and control. SECTION 7 All Ordinances or Resolutions or parts thereof in conflict with this Ordinance are hereby repealed. SECTION 8 This Ordinance shall become effective upon final passage. All actions or proceedings heretofore taken by the City or City Manager which are consistent with this Ordinance are hereby ratified, confirmed and approved.
