AN ORDINANCE APPROVING AN AGREEMENT BETWEEN
PUEBLO, A MUNICIPAL CORPORATION, AND THE
BOARD OF COUNTY COMMISSIONERS OF PUEBLO
COUNTY, COLORADO, RELATING TO THE CONSTRUC-
TION AND OPERATION OF AN ANIMAL SHELTER AND
DOG AND ANIMAL CONTROL PROGRAM AND AUTHORIZING
THE PRESIDENT OF THE CITY COUNCIL TO SIGN SAME
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO,
that:
SECTION 1.
The Agreement dated December 11, 1974 between the City of Pueblo,
a municipal corporation, and the Board of County Commissioners of
Pueblo County, Colorado, relating to the construction and operation
of an animal shelter and dog and animal control program, a copy of
which is attached hereto and incorporated herein, having been ap-
proved by the City Attorney is hereby approved.
SECTION 2.
The president of the City Council is hereby authorized and
directed to execute said agreement for and on behalf of the City
of Pueblo and the City Clerk is directed to attest same and affix
the seal of the City thereto.

A G R E E M E N T
THIS AGREEMENT made and entered into this 11th day of
December, 1974 by and between Pueblo, a Municipal Corporation
herein called City and the Board of County Commissioners of Pueblo
County, Colorado, herein called County.
W I T N E S S E T H:
WHEREAS, City is the owner of certain property near City's
sewage treatment facilities upon which the construction of an
animal shelter would be feasible, and
WHEREAS, a need exists within the City of Pueblo and the
County of Pueblo for an animal shelter building and an effective
program for dog control including the disposal of unwanted animals
and the collection and disposing of dead animals, and
WHEREAS, City and County have determined that it would be in
the best interest of the citizens of both the City and County to
enter into an agreement under the authority of Article 2, Chapter
88, C.R.S. 1963, as amended (Intergovernmental Relations Act) and
Section 3 -8 of the Charter of City to jointly contract for the
construction, maintenance and operation of an animal shelter and
animal control program for the benefit and service of the residents
of the City and Couunty,
NOW THEREFORE, in consideration of the foregoing and mutual
covenants herein contained the parties agree as follows:
1. City and County shall jointly construct upon land owned
by the City near City's sewage treatment facilities an animal
shelter in accordance with the plans and specifications hereto-
fore approved by City and County. The cost of constructing the
animal shelter including site preparation, grading, utility exten-
sions, right -of -way acquisition, road installation, landscaping
and parking area improvements shall be shared equally by the
City and County, each party paying one -half of the costs thereof
within 30 days after final construction of the animal shelter
building.
2. The annual cost of operating the animal shelter and con-
trol program including but not limited to employees' salaries and
benefits, equipment, utilities, building and equipment maintenance
and repairs, dog licenses and tags, office supplies and insurance
premiums shall be shared and paid as follows: eighty percent (80 %)
thereof by City and twenty percent (20 %) thereof by County. County
shall pay to City its twenty percent (20 %) share of annual oper-
ating costs on or before March lst of each year during the effec-
tive period of this agreement commencing March 1, 1975. It is
hereby agreed that County's share of the 1975 annual operating
costs is $18,600.00.
3. The operation of the animal shelter and dog and animal
control program shall be under the general supervision and con-
trol of the City Manager of City or his designee and all personnel
employed in the operation of the animal shelter and control pro-
gram shall be employees of the City. County does hereby appoint
and designate the City Manager of City or his designee as the en-
forcement agent and as the official to be appointed by County
under Article 12, Chapter 36, C.R.S. 1963, as amended.
4. County shall adopt a dog restraint and control resolution
and order pursuant to the authority vested in County by Article 12,
Chapter 36, C.R.S. 1963, as amended, which resolution shall become
effective March 1, 1975.
5. City and County shall jointly adopt such resolutions rea-
sonably required and necessary for the operation of the animal
shelter and for an effective dog and animal control program within
Pueblo County and the City of Pueblo including the imposition and
collection of fees for impounding and keeping of dogs and animals.
Until amended or modified by joint resolution of the City and
County the following fees shall be made and collected at the animal

shelter and shall be used for the operation of the animal shelter:
(a) For impounding any dog or animal ------------------- $2.00
(b) Charge for keeping any dog or animal --------------- $1.00 per
day
(c) Kennel license fee -------------------------------- $35.00 per
year
6. The dog and animal control program including the seizing and
impounding of dogs shall be enforced as herein provided within the
City of Pueblo and within the County of Pueblo in the areas specifi-
cally designated by the County in its dog restraint and registration
resolution.
7. At any time after 10 years from date hereof, either County
or City, upon giving to the other party 12 months prior written
notice specifying the date of termination, shall have the right to
terminate this agreement at the end of any calendar year. Upon
termination City shall no longer enforce the dog and animal control
program outside its corporate limits and County shall not there-
after contribute to the annual operating costs of the animal
shelter and dog and animal control program. Title to the animal
shelter building and all equipment used therefor shall remain with
the City subject to the right of the County and its residents so
long as City oeprates said building as an animal shelter to use
the facilities of the animal shelter subject to payment of a
reasonable fee and in accordance with City's rules and regulations
relating thereto.
8. This agreement shall be binding upon and inure to the
benefit of City and County and their successors.
