WHEREAS, the City Planning and Zoning Commission has recommended that the area commonly known as the Lake Minnequa Area be annexed to the City of Pueblo, and WHEREAS, said Planning and Zoning Commission has recommended that certain parcels of land lying within the proposed Lake Minnequa Area annexa- tion be rezoned, and WHEREAS, City Council has, acting in accordance with the require- ments of the Municipal Annexation Act of 1965, and after hearing, found the area in question to be eligible for unilateral annexation; now therefore BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1. The following described area be, and the same hereby is, annexed to the City of Pueblo, Colorado, a municipal corporation, and the official map of the City shall be amended to show such annexations: All those aliquot portions of Sections including those having platted tracts, not heretofore being a part of the City of Pueblo: The SEk of Section 10 including a portion of Prairie Avenue Place. The SW'k of Section 11, including a portion of Ormandale, all of Buehler Subdivision, all of Himes Subdivision, all of Backman Subdivision. The SE'k of Section 11. The NW'k of Section 13, including a portion of Eastlake, a portion of Eastlake Re- Subdivision. The NE'k of Section 14, including a portion of Eastlake, a portion of Eastlake Re- Subdivision. The NW'k of Section 14. The NEk of Section 15. The SE'k of Section 15. The SW'k of Section 14. The SE'k of Section 14, including all of Sunny Side, all of Lakegarden Second Filing. fflin Recorder BOOK 1 136 ucE 431 The SW's of Section 13, including all of Burton's Sub; and the SE's of Section 13, lying northwesterly of the easterly R.O.W. line of Interstate Highway No. 25; All in Township 21 South, Range 65 West of the 6th P.M. The area to be annexed to the City of Pueblo contains 780.9 acres, more or less. SECTION 2. The following described area is hereby rezoned from A -4, Agricul- tural District, to B -4, Regional Business District, and restrictions govern- ing B -4, Regional Business Districts, shall apply to said area: . A certain parcel of land, being that part of the SWk of Section 14, Twp. 21 South Range 65 West of the 6th P.M., lying South of the South right -of -way line of Colorado. State Highway No. 45, and East of the Easterly right -of- way line of the CF &I Co.'s Minnequa Canal, Northerly of the South line of said Section 14, and Westerly of the North - South Centerline of said Section 14; said parcel of land containing 40.437 acres. SECTION 3. The following described area is hereby rezoned from A -4, Agricul- tural District, to B -4, Regional Business District, and restrictions govern- ing B -4, Regional Business Districts, shall apply to said area: A certain parcel of land, being a part of the SWk of Section 14, Twp. 21 South, Range 65 West of the 6th P.M., more parti- cularly described as follows: Beginning at the intersection of the Northerly right -of -way line of Colorado State Highway No. 45, and the North -South Centerline of said $ection 14 thenc NN ppl 2 ' E. a11on ' o , North -South Centerline a distance o x+90 57�eet tfiene.�s8 32 Li,, a distance of 1495.49 Feet; thence N.89 43 30 , a dis- tance of 274.41 feet to a point on the Easterly right -of -way line of the CF &I Co.'s Minnequa Canal; thence Southerly, along said Easterly right -of -way line, to a point on the said North- erly right -of -way line of Colorado State Highway No. 45; thence Easterly along said Northerly right -of -way line to the point of beginning; containing 16.088 acres. SECTION 4. The following described area is hereby rezoned from A -4, Agricul- tural District, to R -7, Mobile Home Residential District, and the restric- tions governing R -7, Mobile Home Residential Districts, shall apply to said area: A certain parcel of land being a part of the SWk and the NW'k of Section 14, Twp. 21 South, Range 65 West of the 6th P.M., more particularly described as follows: Beginning at the Southeast boundary corner of Mahoney Sub- division, Third Filing, according to the recorded plat there - of; thence South, a distance of 1047.76 feet; thence N. 88 32' E., a distance of 995.81 feet, to a point on the North - South Centerline of the said Section 14; thence Northerly along said North -South Centerline, to a point on the South - 2 - , As Amended.11/27/72 BOOK1736 PALE4 line of Parcel "D" of Lake Minnequa Reservation. Second Filing, according to the recorded plat thereof; thence S. 89 20' W., along said South line, a distance of 652.35 feet, to a point on the Southerly right -of -way line of the said CF &I Co.'s Minnequa Canal; thence Westerly, along said Southerly right -of -way line to the Northeasterly boundary corner of Mahoney Subdivision, Third Filing, according to the recorded plat thereof thence South, along the Easterly boundary of said Mahoney Subdivision, Third Filing, a dis- tance of 1768.00 feet, to the point of beginning; containing 65.496 acres. SECTION 5. The following area is hereby rezoned from A -4, Agricultural District, to R -5, Multiple Residential and Office District, and the restrictions govern- ing R -5, Multiple Residential and Office Dist =icts, shall apply to said area: A certain parcel of land being a part of the SW'k and the NW'k of Section 14, Twp. 21 South, Range 65 West of the 6th P.M., more particularly described as follows: Beginning at the Southeast boundary corner of Mahoney Sub- division, Third Filing according to the recorded plat there- of; thence West, along the South boundary line of said Mahoney Subdivision, Third Filing, to a point on the Easterly right -of -way line of the CF &I Co.'s Minnequa Canal; thence S. 0 42' E., along said right -of -way, a distance of 259.59 feet; thence S. 89 20' W., and continuing along said right - of -way, a distance of 24.84 feet; thence S. 03 29' E., (record) and continuing along said right -of -way, a distance of 880.89 feet; thence S. 89 43' 30" E., a distance of 274.41 feet; thence N. 88 32' E., a distance of 499.67 feet; thence North, a distance of 1047.76 feet to the point of be- ginning; Containing 19.372 acres. SECTION 6. This Ordinance shall become effective immediately upon final passage and approval, and the liability for general ad valorem taxes shall attach against the property described in Section 1 hereof on January 1, 1973. SECTION 7. Anything contained in this Ordinance to the contrary notwithstand- ing,.the annexed land including all business and activities conducted thereon shall become and remain subject to all applicable Ordinances of the City of Pueblo effective 12:01 A.M., January 1, 1973, except as follows: (a) The licensee of any establishment selling fermented malt beverages and /or alcoholic beverages who has, or will have, a valid fermented malt beverage and /or alcoholic beverage license on January 1, 1973, shall not be required to obtain another such license approved by the City Council, City Pueblo, as local licensing authority until the expiration of such license, but such licensee shall be obligated to pay all liquor occu- pations tax imposed by Chapter 2, Title XIV of the 1971 Code - 3 - f As Amended 11 BOOK 7Jia PAS€ m of Ordinances for the year 1973 and subsequent years. (b) The requirements for cabaret licenses pursuant to Sections 9 -2 -3, 5 and 6 of the 1971 Code of Ordinances shall not be applicable to any business conducted on the annexed land until July 1, 1973 and the license fee for such license for the balance of the 1973 calendar year shall be $50.00.
