Section 1. That The Atchison, Topeka and Santa Fe Railway Company, its successors and assigns, be
and it is hereby granted the right, privilege and License to locate, construct, operate and maitain a single or
double track railway and telegraph line, with all the necessary side - tracks, turnouts, switches, depots, shops,
yards, and all other appliances required for the transaction of its business within the city of Pueblo, and through
and across the streets and
alleys thereof, as follows:
Section 2, The said Railway Company is hereby authorized to begin the construction of its said line of
road at a point on the east line of Hood Street, being the west line of the State Insane Asylum grounds, and
between the north line of Twelfth Street and the railway now operated by the said Railway Company, and
extend thence in a general northwesterly direction over and across blocks numbered twenty -five (25), twenty -
four (24), seventeen (17), sixteen (16), fifteen (15), fourteen (14), seven (7) ad four (4), or any of them, in
Adee, Chamberlin and Wiley's Addition or Subdivision; and thence, in the same general northerly or
northwesterly direction, over and across blocks numbered twenty -six (26), twenty -five (25), twenty -three (23),
twenty -four (24), nineteen (19) and twenty (20), or any of them, in Irving Place, and blocks numbered thirty -four
(34), thirty -three (33), thirty -two (32), twenty -nine (29), twenty -six (26), twenty -three (23), twenty (20), nirwen
(19), eighteen (18), seventeen (17), twelve (12), eleven (11) and ten (10), or any of them, in Irving Place second
fling, and blocks numbered thirty -eight (38), thirtyseven (37), thirty -six (36), twenty (20), twentyone (21),
eighteen (18), seventeen (17), three (3), four (4), fifteen (15), sixteen (16), seventeen (17), twenty -three (23),
twenty -four (24), twenty-five (25), thirty -three (33) and thirty -four (34) in La Veta Park, and Blocks Thirty (30)
Thirty -one (31) and Thirty -two (32) in Fairmount Park third filing, or any of them, to the limits of the city of
Pueblo; and to construct, operate and maintain its tracks lines and equipment as aforesaid on the aforesaid
route, and over and across all streets and alleys which may be crossed and intersected by the said road and
tracks so to be constructed upon the route aforesaid. Said Railway Company is authorized to make, build and
construct any and all cuts, fills, bridges, trestle- works, culverts, overhead or other crossings, as may be
necessary, along or upon the said line of road above described, and across the streets and alleys aforesaid.
Section 3. The rights, privileges and licenses hereby granted to the said Railway Company are granted
subject to all ordinances and police regulations of the city of Pueblo now in force or that may heeafter be
adopted; and the said railway company shall cause drainage boxes or pipes to be placed under or across its
right of way whenever the natural drainage of the country may require the same.
Section 4. The grant hereby made is upon the condition that, upon the completion of the track on the
alignment aforesaid, and its use by the said Railway Company as a permanent through line in connection with
its line to Colorado Springs, the said Railway Company shall take up and remove the main track now used by it
between the north line of the city of Pueblo and north line of West Tenth Street at or near its intersection with
Baxter St.; and thereupon, the said company shall abandon all right to maintain the said portion of its present
main track and all franchises for the maintenance thereof, -- the said track having been constructed under
ordinance passed March 28, 1887, in favor of the Denver and Santa Fe Railway Company, to the rights of
which company The Atchison, Topeka and Santa Fe Railway Company has succeeded. Upon the removal of
the said track, the Railway Company shall do such work of grading filling at the points where the track to be
removed now intersects all streets and alleys south of the north line of Craig's Addition, as may be necessary to
put the crossings thereat in serviceable condition for street use. The Railway Company, by accepting the
benefits of this ordinance, hereby agrees to the terms hereof, and to the removal of the part of its present main
track and the abandonment of the franchise rights therefore, as aforesaid; and the said Railway Company by
its acceptance likewise perpetually confirms to the city of Pueblo the right of the said city to maintain its streets
and alleys now shown by the official plats, over and across the property of the said Railway Company within the
city limits, on the line to be abandoned as aforesaid, in all respects as though said streets and alleys had been
heretofore legally established.
