AN ORDINANCE fixing a license fee and regulating Second hand Stores:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PUEBLO, COLORADO
Section 1.
That from and after the passage of this Ordinance, it shall be unlawful for any person,
company or corporation to engage in and carry on the business of Second hand Stores or dealers in
Second hand goods, or what is commonly known as Second hand Stores, without first having
obtained a license therefor.
Section 2.
Any company, corporation or person desiring to engage in the business of carrying on a
Second hand store or dealers in second hand goods in said store shall make application for a license
therefor to the City Council stating in said application the name of the person, persons or corporation
desiring to engage in said business and the proposed place of business accompanied by a certificate
of the City Clerk that the fee has been paid; provided in case of corporations it shall be the duty of
said corporation to give the name of its president, directors and secretary.
Section 3.
The City Council may, if it is satisfied that the applicant is a suitable person to carry on the
business of Second Hand Store order a license to issue to said applicant upon the payment thereof to
the City Clerk by said applicant or applicants, the sum of sixty dollars per annum in advance quarterly.
Section 4.
It shall be unlawful for any Second hand dealer, by himself, his agent, or servant, to purchase
any personally, of or for, or deal with any minor under the age of 18 years, without the written consent
of the parent of guardian of such minor, or from any minor purchase any second hand articles
whatsoever, of any nature or kind as defined by this ordinance.
Section 5.
Every person, persons or corporation licensed as a Second dealer under the provisions of this
ordinance, shall keep at his, her, or its place of business a substantial and weel bound book in which,
he or she or it, shall make a minute description of all personal property purchased by said Second
hand dealer, the date of the purchase, the name and residence or place of business of the person or
persons from whom such purchase so was made, and particularly mention any prominent or
descriptive marks that may be on said. property, which said book shall be kept clean and legible and
all the entries made therein shall be made in ink.
Every person so licensed shall during the ordinary hours of business when requested by the
Chief of Police, or any police officer, or the Sheriff of Pueblo County or any deputy sheriff, submit and
exhibit said book described above to the inspection of any of the above named officers and shall also
exhibit such goods or personal property to any of the aforesaid officers.
Section 6_
Any person who keeps a store office or place of business for the purchase or sale of second
hand clothing or garments of any kind or second hand goods, wares or merchandise, except books,
musical instruments or curiosities, is hereby defined to be a dealer in second hand goods.
Section 7_
Any person, persons, firm, or corporation or representatives thereof, violating any of the
provisions of this ordinance, shall, upon conviction, be fined in any sum not less than twenty -five (25)
nor more than one hundred and fifty (150) dollars.
