An ordinance providing a license fee for the sale of goods, wares and merchandise
within the City of Pueblo and prohibiting such sales except under the authority of a license from
said City, and providing a penalty for violation thereof.
Be it Ordained by the City Council of the City of Pueblo, Colorado:
Sec. 1. It shall not be lawful for any person, corporation or firm to enter the business of
selling wares or merchandise of any kind of description whatever in the City of Pueblo without
having first obtained a license so to do. No license for such purpose shall be issued for a less
period than one month and the fee to be charged therefore shall be as follows:
For one month five per cent upon the total value of the stock of goods of such person,
firm or corporation.
For six months ten per cent of the entire value of such stock.
For one year twelve per cent of the entire value of such stock.
Before any such license is issued to such person, firm or corporation, the City Clerk shall
estimate carefully and accurately the value of any such stock and may take testimony in relation
thereto, and the license fee so to be charged shall be based upon the information thus obtained;
provided if any such person, firm or corporation shall enter the business of selling wares and
merchandise with the bona fide intention of becoming permanent resident merchants in said
City, and the Mayor and City Clerk shall be satisfied of the bona fide intention of such person,
firm or corporation. The said Mayor and City Clerk may in lieu of such license fee take from
such person, firm or corporation a bond in double the amount of the license fee herein fixed for
the period of one year, the conditions of which said bond shall be that, if the said person, firm or
corporation shall discontinue such business at any time within the period of one year than they
shall pay to the City of Pueblo the license fee hereinabove provided for the full period of one
year; but if such person, firm or corporation shall continue such business for the full period of
one year and become bona fide resident merchants of said City the such obligation shall be null
and void and no license fee shall be exacted from such person, firm or corporation. Such bond
shall be signed by two or more sufficient sureties, who are residents of the City of Pueblo, to be
approved by the Mayor.
Sec. 2. It shall not be lawful for any person, firm or corporation to bring into the City of
Pueblo any stock of merchandise of any kind or description whatever and advertise the sale
thereof as a "fire sale ", "insurance sale ", "assignee's sale ", "closing out sale ", "bankrupt sale" or
sale of a similar character without having first obtained a license from said City so to do. The
license fee for such purpose shall be as follows:
Three per cent on the value of such entire stock for the first week.
Two per cent on the value of such entire stock for the second week.
One per cent on the value of such entire stock for each and every week thereafter that
such sale shall be continued.
Sec. 3. It shall not be lawful for any person to solicit orders from consumers for any
clothing, goods, wares or merchandise of any kind or character whatever within the limits of the
City of Pueblo without having obtained a license from said City so to do. The license fee to be
charged therefore shall be ten dollars for the first day and five dollars per day for each and
every day thereafter; provided that this section shall not apply where orders are solicited
and are to be filled from stocks of goods carried in the City of Pueblo on which taxes are paid,
nor shall it apply to any food products which are grown or raised within the State of Colorado by
the person having them for sale, nor to traveling salesmen, who represent wholesale houses
and solicit orders from dealers only.
Sec. 4. This ordinance shall not be held as amending or repealing or in any manner
effecting any other ordinance or ordinance of said City in relation to licenses.
Sec. 5. Any person violating any of the provisions of this ordinance shall be fined in any
sum not less than two or more than three hundred dollars for each offense, and each day that
any such business shall be continued without a license shall be regarded as a separate and
distinct offense.
