HomeMy WebLinkAbout00506ORDINANCE; NO 506 An Ordinance concerning City Officers. Be it ordained by the City Council of the City of Pueblo Colorado. Section 1. The City Council of the City of Pueblo shall consist of a Mayor and board of Alderman, who shall be elected as provided by law. Section 2, The Mayor shall be ex- officio a member of the City Council., and shall be the presiding and Chief Executive Officer thereof; he may vote in all cases of a lie vote except upon the passage of ordinances or resolutions or others involving the ex- penditure of money. Section 33. The members of the City Council shall elect from their own body an acting Mayor or Mayor Protem who shall hold his office during the life of the Council and until the Council is reorganized and who shall., in the absence of the Mayor be presiding officer of the Council. The acting Mayor or Mayor Protem, shall have the right to vote an any and all questions before the Council. Section 4. When the Mayor is absent from the City of is for any reason temporarily unable to perform the duties of his office, the acting Mayor shall have and exercise all the authority and power conferred upon the Mayor by law or ordinance; and in case of the protracted absece of the Mayor or his inability to act, the acting Mayor shall receive the same compensation as that received by the Mayor. Section 5. Each and every officer of the City of Pueblo whether elected or appointed shall before entering upon the duties of his office, take and subscribe an oath before some officer authorized to administer oaths that he will well and truly perform the duties of his office to the best of his skill and ability said oath to be in the form prescibed by law. Section 6. The Council shall as soon as practicable, subsequent to its organization after each City election appoint a Police Magistrate, a Chief of the Fire Department, and assistant Chief of the Fire Department, a Health Commissioner, and a Street Commissioner and such other officers as may from time to time be provided for by law or ordinance and whose election or appointment is not otherwise provided for; all officers so appointed shall hold their office during the life of the Council appointing then and until the reorganization of the City Council after the next succeeding City election, unless sooner removed for cause. Section 7. The officers hereinafter mentioned shall before entering upon the duties of their respective offices, execute bonds to the City to be apporved by the Mayor and Auditor of said City and conditioned that they will faithfully perform the duties of their respective offices, and that they will, when they vacate the same, surrender and turn over to their successors in office all monies, books, papers, property and other things in their custody or control belonging to the City. The penalties of the bonds as required by this section shall be as follows: For City Clerk, the sum of ten thousand dollars. For City Au� ditor the sum of ten thousand dollars. For City Treasurer the sum of two hundred thousand dollars. For Police Magistrate the sum of five thousand dollars. For City En ii neer, the sum of three thousand dollars. For Chief of Fire Department, the sum of two thousand dollars. For Assistant Chief of Fire Department the sum of one thousand dollars. For Chief of Police. the sum of two thousand dollars. for Street Commissioner the sum of two thousand dollars. For Health Commissioner the sum of two thousand dollars. Said bonds shall be filed with the Mayor of said City and by him preserved in some secure place, subject however, at all times, to the inspection of the City Council and of any taxpayer of the City, who shall desire of e-camine the same. Section 8. All of said Coty officers shall, at tge end of each month, or oftener if required, make to the City Council a report in writing of all mo#i.es received by them, and on what account received, and of their daily payments to the City Treasurer. Se ction 9 The Clerk, Marshall, Engineer, Auditor,, Attorney, Police Magistrate, Chief of the Fire Department, Chief of Police and all other City officers receiving money be— longing to the City, shall, before 3 o'clock P.M. on each day pay over of the City Treasurer, all money then in their hands and take his receipt therefor; specifying the date of payment and on what account paid. Section 10. The Treasurer shall at 3 o'clock P.M on each day deposit in the bank all monies then in his hands belonging to the City, and the accounts therefor shall be inscribed as with the City Treasurer of the City. Section 11. Any violations of any of the provisions of the four foregoing sections shall subject the offender to immediate removal from office by the City Council who shall declare said office vacant and appoint a successor who shall hold his office for the remainder of the tern unexpired of such officer so removed.
