ORDINANCE NO 502
An Ordinance prohibiting persons under sixteen years of age from being on the
streets, alleys or public places in the City of Pueblo, Colorado, at night after
the hour of nAne o'clock P.M. from April lot to Septem*r 30th, inclusive, of each
year, and from October 1st to the last day of March inclusive of each year, after
the hour of eight o'clock P.M. and prescribed penalties for the violation thereof.
Be it ordained by the Mayor and Council of the City of Pueblo, Colorado.
Section 1.
It is hereby made unlawful for any person under sixteen years of age to be or
remain in or upon any of the streets, alleys or public places in the City of Pueblo
Colorado at night after the hour of nine o'clock P.M. from April lot to September 30th
inclusive of each year; and from October lot to the last day of March of each year
inclusive, after the hour of eight o'clock P.M. unless such person is accompanied by
a parent, guardian or other person having legal custody os such minor person, or is
in the performance of an errand or duty directed by such parent, guardian or other
person having the care and custody c$ such minor person, or whose employment makes
it necessary to be upon said streets, alleys or other public places during the night
time after the said specified hours; PROVIDED, this_ exception shall not apply when
a person under such age shall be playing or unnecessariy loitering in or upon
such streets, alleys or public places, whether alone or accompanied by a parent
guardian, or any person or persons whoma0ssPer. Any person violating the provisions
of this section shall, on conviction, be fined in any sum not to exceed ten dollars
for such offense, and stand committed until such fine and costs are paid.
Section 2.
It is hereby made unlawful for any parent, guardian or other person having the
legal care and custody of any person under the age of sixteen years, to allow or
permit any such child, ward, or other person under such age, while in such legal
custody, to go or be in or upon any of the streets, alleys or public places in said
City within the time prohibited in section 1 of this ordinance, unless there exists
a reasonable necessity therefor. Any person violating any of the provisions of this
section shall, on conviction, be fined in any sum not exceeding twenty -five dollars
for each offense and stand committed until such fine and costs are paid.
Section 3.
Each member of the :'olice Force, while on duty, is hereby autorized to arrest,
without warrant, any person wilfully violating the provisions of section 1 of this
ordinance. Be it further ordained, that no child or minor person arrested under the
provisions of this ordinance shall be placed in confinement until the parents, or
guardian of such minor person, shall have been notified of such arrest and shall
have refused to be held resposible for the observance of the provisions of this
ordinance by said minor person.
Section 4-
This ordinance shall take effect and be in force from and after its passage
approval and publication according to law.
