AN ORDINANCE Concerning pawnbrokers.
Be it ordained by the City Council of the City of Pueblo, Colorado.
Section 1.
Ir shall be unlawful for any person, company or corporation to establish or
conduct the business of pawnbroking within the City of Peublo, without first
having procured a license from and executed a bond to the City of Pueblo as
herein set forth.
Section2.
Before any person, company or corporation shall receive a leicense for carrying
on the pawnbroking business, he, she or they, shall enter into a bond, running
to the City of Pueblo, with two or room sureties to be approved by the Mayor
or City Auditor, in the sum of one thousand dollars (1,000) conditioned for the
due observation of this and all other ordinances now in force or hereinafter
passed respecting pawnbrokers, at any time during the continuance of said license
and for the safe keeping and return of all articles held in pawn by such pawn—
broker, in accordance with the provisions of this act; Whereupon, and upon the
payment of a license fee of sixty dollars (460.00 per annum, a license shall
issue to such person, company, or corporation; provided, that no such license
shall be issued for a less period than six, months, and each half yearly license
tax shall be payable in advance; Such license shall state the name of the person,
company or corporation to whom issued, and the street number where the business
is to be carried on, and the amount paid for such license.
Section 3.
Every person, company or corporation ehgaged in the pawnbro #i.ng business,
shall keep a book, in which shall be clearly written, at the time of each loan, an
accurate account and description of the goods, articles and things pawned, the amount
of money loaned theron, the time of pledging the same and the rate of interest to b
paid on said loan; and the name and address of the person pawning or pledging
the said goods, articles or things. The said book at all times shall be open to the
a
inspection of the Mayor, Chief of Police or any of the police force of the City
of to any person who shall be duly authorized by the r•iayor or Chief of Police,
and who shall exhibit such authority, to said pawnbroker.
Section 4-
No person, company or corporation engaged in the pawnbroking business, shall
sell any pledge, or pawn until the same shall have remained six months in his or
her or its possession after forfeiture, nor until 'he she,or- At'shall have given
the pledgor ten days notice by mail, stating the time in which he must redeem his
or her property; such notice to be addressed to the pose office designated by the
pledgor as his or her proper post office address.
Section 5.
No person, company or corporation engaged in the pawnbroking business, shall
make any loan to any person under the age of fifteen years, except upon the written
consent of the parent or guardian of said minor.
Section 6.
Every person, company, or corporation who shall violate, neglect, fail or
refuse to comply with any or either of the foregoing provisions, shall upon con—
viction, be fined in a sum not less than fifty. dollars ($50.00) nor more than one
hundred dollars 0100.00) for each and every offense.
Saction 7.
The term "pawnbroker" as used in this ordinance, shall be taken and held to
mean any person, compnay, or corporation who loan money on personal property, or
who deal in the purchase or possession of personal property on condition of selling
the same back again, or taking chattel mortgage security thereon and take such
personal property into his, her, or their possession.
Section 8.
That Art. 1 of Chap 18 of the revised ordinances of the City of Pueblo, of 1892
and Ordinance No. 422 and all other ordinances or parts of ordinances in conflict
herewith, be and the same are hereby repealed.
