HomeMy WebLinkAbout004874 P ORDINANCE. NO 487 An Ordinance granting the right of way to the Puelbo and Arkansas Valley Railroad Company. Be it ordained by the City Council of the City of Pueblo. Section 1. There is hereby granted to the Pueblo and Arkansas Valley Railroad Company its successors and assigns the right, privilege and license to locate I construct, and operate an additional line of track in the alley running east and west between Second and Third Streets. The same to branch off from its main track in the alley in Block 41 p of the original town of Pueblo and on the easterly side of said block and extend easterly along said alley across Court Street and along the a lley in Block 32 of the original town of Pueblo, for the purpose of affording trackage facilities to the property abutting on said alley. Section 2. The right, privilege and license to said Railroad Company is hereby granted subject to all the ordinances and police regulations of the City of Pueblo now in force or that may hereafter be adopted and more particulaly subject to the following terms and condition viz: The trakc through said alley shall be laid so as to conform of the grade thereof as now established. II At the point where said railroad Company constructs its track across Court Street, as afore said it shall keep:the said crossing and the said street for a space of fifteen feet on each side of its track, in good condition,.and repair. III The Said Railroad Company Shall protect public travel on the said street and maintain crossing gates at the point of intersection as the needs thereos may from time to time arise as required accordingly by ordinance of said City. FTl The said company shall construct and maintain in good repair suitable culverts, drains and gutters for and under its tracks where necessary, so that the natural drainage of the property adjacent there and of the streets shall not be impeded or obstructed. V The track across said Court Street throughour the entire width of said street, shall be laid so as to conform to the grade thereof, as now or hereafter est4blish- ed, and the said Railroad Company shall plank said track, so to be laid and the track heretofore laid across said street in said alley and now used by said Company between the rails of both lines of said track and on the outside off each rail in such manner as to make a suitable and proper crossing for vehicles being driven along said street. The laying of said track across said street and the planking aforesaid, to be done under the supervision of the Street Commissioner and the Street and Bridge Committee in a manner satisfactory to them.
