HomeMy WebLinkAbout10743 City Clerk's Office Item # R6 Background Paper for Proposed Ordinance COUNCIL MEETING DATE: July 22, 2024 TO: President Mark Aliff and Members of City Council CC: Mayor Heather Graham VIA: Marisa Stoller, City Clerk FROM: Chris Noeller, Chief of Police SUBJECT: AN ORDINANCE TO CLOSE OUT PROJECT PST2202 AND TRANSFER ALL REMAINING FUNDS INTO THE PUBLIC SAFETY SALES TAX (PSST) FUND OPERATING BUDGET SO THESE FUNDS CAN BE USED BY THE PUEBLO POLICE DEPARTMENT TO UPFIT OTHER VEHICLES AND FUND OTHER PUBLIC SAFETY PROJECTS SUMMARY: Project PST2202 was created during the budget process and funded with $1,078,000.00 to fund the purchase of all electric police vehicles. The Pueblo Police Department purchased and upfitted 13 marked police vehicles (Mustangs). The Pueblo Police Department has excess funds in this account that they can only use to purchase new electric vehicles and they have a need to upfit other vehicles and complete other police/public safety projects. PREVIOUS COUNCIL ACTION: Project PST2202 was created during the budget process and funded with $1,078,000.00 to fund the purchase of all electric police vehicles. BACKGROUND: Project PST2202 was created during the budget process and funded with $1,078,000.00 to fund the purchase of all electric police vehicles. The Pueblo Police Department purchased and upfitted 13 marked police vehicles (Mustangs). The Pueblo Police Department has excess funds in this account that they can only use to purchase new electric vehicles and they have a need to upfit other vehicles and complete other police/public safety projects. The Pueblo Police Department cannot utilize these funds as they are currently dedicated to this project. This Ordinance will transfer the remaining fund balance back into the Public Safety Sales Tax budget Operating Expenses which will allow the Pueblo Police Department to utilize the funds to upfit a number of other vehicles as well as fund other public safety projects. FINANCIAL IMPLICATIONS: The funds currently are dedicated to Project PST2202 and have no financial impact on the general budget. BOARD/COMMISSION RECOMMENDATION: Not Applicable. STAKEHOLDER PROCESS: Not Applicable. ALTERNATIVES: Council can choose to leave the money in the project which will not be able to be accessed by the Pueblo Police Department for use in upfitting other vehicles or working on other public safety projects which will not benefit the safety of the citizens of Pueblo. RECOMMENDATION: Approval of the Ordinance. ATTACHMENTS: None ORDINANCE NO. 10743 AN ORDINANCE TO CLOSE OUT PROJECT PST2202 AND TRANSFER ALL REMAINING FUNDS INTO THE PUBLIC SAFETY SALES TAX (PSST) FUND OPERATING BUDGET SO THESE FUNDS CAN BE USED BY THE PUEBLO POLICE DEPARTMENT TO UPFIT OTHER VEHICLES AND FUND OTHER PUBLIC SAFETY PROJECTS WHEREAS, the City Council of Pueblo has the authority on behalf of the City of Pueblo, including its Police Department, to create and liquidate projects using Public Safety Sales Tax funds WHEREAS, Project PST2202 was created during the budget process and funded with $1,078,000.00 to fund the purchase of all electric police vehicles. The Pueblo Police Department purchased and upfitted 13 marked police vehicles (Mustangs) WHEREAS, Project PST2202 has been completed and the remaining funds cannot be utilized without liquidating the project and transferring the remaining fund balance back into the Public Safety Sales Tax operating budget. Liquidating Project PST2202 is in the best interest of the City and will benefit the health, welfare and safety of the citizens of the City; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. Project PST2202 is hereby liquidated and all remaining funds are to be transferred back into the Public Safety Sales Tax operating budget. SECTION 2. The Mayor of the City is authorized to approve the liquidating of Project PST2202 and to have the reaming fund balance transferred back into the Public Safety Sales Tax operating budget. SECTION 3. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of this Ordinance and the attached award to effectuate the policies and procedures described herein. SECTION 4. The Ordinance shall become effective on the date of final action by the Mayor and City Council.
