PREVIOUS COUNCIL ACTION: None. BACKGROUND: The subject property was annexed into the City in 1973 and subdivided as part of the Foothills Subdivision in 2000. In 2024, the property was re-subdivided into Lot 1, Block 11, Pikes Peak Park, Filing No. 1. The property is currently zoned in Pikes Peak Park Planned Unit Development (PUD), which is envisioned to become a mixed-use and mixed-income community. The City of Pueblo is requesting to rezone this 1.74-acre parcel from the PUD District to a Government Use (S-1) district to facilitate the construction of the new fire station #11. This lot is adjacent to the developing Pikes Peak Park PUD and the existing West Valley Estates subdivision, and its location will allow the new station to serve the western Pueblo area as new development continues. This requested construction is concurrent with two other fire station projects, stations #6 services. The S-1, Government Use District is intended to retain and provide land areas held, used, or controlled for governmental purposes by or for any department or branch of government. Generally, land owned and actively used by local, state, or federal governments, such as public schools or special districts, is zoned S-1. The proposed fire station is consistent with the intended purpose of the S-1 Zone District. FINANCIAL IMPLICATIONS: There are no financial implications for the City. BOARD/COMMISSION RECOMMENDATION: The Planning and Zoning Commission, at their June 12, 2024 Regular Meeting, voted 7-0 to recommend approval. STAKEHOLDER PROCESS: The Planning Department sent out Notice of the Planning and Zoning Commission Public Hearing to all property owners located within 300 feet of the subject property. A Public Notice poster was placed on the subject property 15 days prior to the Public Hearing. ALTERNATIVES: If City Council does not approve this Ordinance the property will remain zoned within the Pikes Peak Park PUD and be subject to the PUD requirements. Upon request of City Council, the Ordinance could be returned to the Planning and Zoning Commission for consideration of proposed modifications. RECOMMENDATION: Approval of the Ordinance. ZONING AMENDMENT TEST The standard for accepting an amendment to the zoning map is that the proposed zoning action must either: 1) Further the goals and objectives of the comprehensive land use plan, or Comments This rezoning will further the goals of the 2022 Comprehensive Plan as it will provide fire services to the burgeoning West Pueblo residential community. 2) Show that the area has changed significantly since the adoption of the comprehensive land use plan Comments Not Applicable 3) Show that there was a mistake or error made in the original zoning of the property. Purpose of S-1 Zone District Standards: The standards of this district are designed to retain and provide land areas held, used or controlled for governmental purposes by or for any department or branch of government, federal, state, county, municipal, school or special district, either as owner or under contract or lease with another person, and to place the public and all elected officials and public agencies on notice of proposed changes in the use and development of such public lands. Governmental purpose means and includes any use or activity, which is reasonably necessary in the discharge of a public or governmental function, whether it is performed by a governmental entity or another person for or on behalf of a governmental entity. RECOMMENDED ACTION: Staff recommends the Planning and Zoning Commission make the necessary findings of fact to forward a recommendation to City Council that the rezoning be APPROVED.
