HomeMy WebLinkAbout10733ORDINANCE NO. 10733 AN ORDINANCE APPROVING AND ACCEPTING A 2023 COLORADO DIVISION OF CRIMINAL JUSTICE, OFFICE OF ADULT AND JUVENILE ASSISTANCE, COMMUNITY INITIATIVE TO REDUCE VIOLENCE GRANT IN THE AMOUNT OF $131,660, RATIFYING THE PRIOR SIGNATURE OF THE MAYOR TO EXECUTE THE GRANT AWARD LETTER AND RELATED DOCUMENTS, ESTABLISHING PROJECT NUMBER CI2219, AND BUDGETING AND APPROPRIATING THE GRANT FUNDS OF $131,660 TO SAID PROJECT WHEREAS, the City Council of Pueblo has the authority on behalf of the City of Pueblo, including its Police Department, to accept grants for public and municipal purposes and to enter into agreements relating thereto; and WHEREAS, the Colorado Division of Criminal Justice, Office of Adult and Juvenile Assistance, Project Community Initiative to Reduce Violence has tendered an award ("Award") for Project No. 2023-CP-23-11 / Community Initiative to Reduce Violence Grant Program (Pueblo) in the amount of $131,660.00 upon conditions recited therein or incorporated therein by reference; and WHEREAS, acceptance of the Award for the purposes for which it has been made is in the best interest of the City and will benefit the health, welfare, and safety of the citizens of the City; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Grant Award Letter (Intergovernmental Grant Agreement), PSN Grant#: 2022-GP- 23-04, ("Agreement") between the State of Colorado Division of Criminal Justice, Office of Adult and Juvenile Assistance, and the City of Pueblo, a Municipal Corporation, for Project Safe Neighborhood Grant Program, a true copy of which is attached hereto, having been approved as to form by the City Attorney, is hereby approved. SECTION 2. Pueblo is hereby approved and ratified, and the execution by electronic signature is attributable to the City of Pueblo. SECTION 3. Project No. CI2219 is hereby established. SECTION 4. Grant funds in the amount of $131,660.00 shall be accepted pursuant to the Agreement and budgeted and appropriated to Project No. CI2219. SECTION 5. Pursuant to the Agreement, the State of Colorado, Colorado Division of Criminal Justice, Office of Adult and Juvenile Assistance, ("State") may unilaterally amend the terms of the Agreement or the amount of grant funds pursuant to an updated Grant Award Letter or other change letter. In the event the State increases the grant award via such a letter, the additional funds may be accepted pursuant to this Ordinance and budgeted and appropriated into Project No. CI2219, where said funds shall only be expended and used for this project. SECTION 6. The officers and staff of the City are authorized to perform any and all acts consistent with this Ordinance and to implement the policies and procedures described therein. SECTION 7. This Ordinance shall become effective upon final action by the Mayor and City Council. Action by City Council: Introduced and initial adoption of Ordinance by City Council on June 24, 2024. Due to clerical oversight caused by staff turnover, an Ordinance accepting and approving the grant funds was not presented prior to signatures by City Staff, establishing Project Number CI2219, and the budgeting and appropriating of grant funds. This Ordinance approves the Grant Agreement and ratifies City Staff's prior signature thereto. PREVIOUS COUNCIL ACTION: None. BACKGROUND: The City has already established Project Number CI2219 as well as the budgeting and appropriating of grant funds. This will retroactively approve the actions of the City. FINANCIAL IMPLICATIONS: No additional financial implications will result from this Ordinance. Previously grant funds in the amount of $131,660.00 were budgeted and appropriated into Project No. CI2219. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Ordinance. STAKEHOLDER PROCESS: None. ALTERNATIVES: City Council could choose to decline to ratify the prior signatures and return the grant award. RECOMMENDATION: Approval of the Ordinance.
