HomeMy WebLinkAbout15683RESOLUTION NO. 15683 A RESOLUTION AMENDING THE LEGISLATIVE PROCEDURES AND RULES OF THE PUEBLO CITY COUNCIL BY CREATING A POLICY REGARDING ELETRONIC PARTICIPATION AND DUTIES OF THE CITY CLERK. WHEREAS, City Council desires to amend the Legislative Procedures and Rules of Council to allow for the creation of a written policy regarding electronic participation and duties of the City Clerk; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that SECTION 1. The Legislative Procedures and Rules of Council is amended as follows: 8. Voting. (b) Whenever a vote is taken, each Council member present shall vote "aye" or "nay" and record such vote upon the electronic voting machine by moving the appropriate switch. After all members have so voted, the \[presiding officer\] City Clerk shall cause the vote of the Council to be flashed upon a recording board which board shall be plainly visible to the City Council and spectators present in the Council Chambers. The City Clerk shall then record the vote of each member of the City Council upon the Journal of the Council's proceedings before passing on to the next order of business. 36. Electronic Participation Rules For City Council Meetings These rules specify the circumstances under which the Mayor and City Councilmembers may participate in regular meetings, special meetings, work sessions, participation by video or audio means, such as Zoom, Microsoft Teams or similar platform approved by the City, which is clear, uninterrupted and allows two-way communication for the participating Councilor(s). (a) If a member of City Council is unable to attend in person, the Councilmember shall contact the President of Council and the City Clerk in advance of the meeting to determine if arrangement for Electronic Participation is possible. In submitting such request, the Councilmember agrees to comply with all requirements for Electronic Participation. Councilmembers shall endeavor to advise the President of Council and the City Clerk of their intent to participate via Electronic Participation at the earliest possible time and not less than twenty-four (24) hours prior to the meeting. (b) Upon receipt of such request, the City shall use its best efforts to provide the technical means necessary to fulfill the request from City Hall; provided, however, that it shall be incumbent upon the Councilmember who desires to attend by Electronic Participation to provide the technical means necessary to facilitate remote attendance from their location. If Electronic Participation is not possible, a telephone connection may be employed. (c) The City shall, to the extent feasible, initiate the Electronic Participation not later than ten (10) minutes prior to the scheduled time of the meeting. Upon any disconnection during a meeting, City staff shall attempt to re-initiate the connection. (d) All members of City Council shall be able to hear one another and Councilmembers appearing by Electronic Participation shall be able to hear all discussion and testimony in a manner designed to provide maximum notice and participation. (e) Elected officials participating by Electronic Participation shall have their cameras on during the meeting. (f) Elected officials participating by Electronic Participation during an executive session shall ensure that they have a secure connection, and shall ensure they are alone while participating in an executive session. SECTION 2. The officers of the City are authorized and directed to perform any and all acts consistent with the intent of this Resolution to effectuate the policies and procedures described herein. SECTION 3. This Resolution shall become effective immediately upon final passage. SUMMARY: This Resolution approves an amendment to the Pueblo Municipal Code, Appendix A, creating a policy for electronic participation as defined therein. Additionally, this City Clerk causing the display of PREVIOUS COUNCIL ACTION: None. BACKGROUND: City Council directed staff to prepare the attached Resolution to amend Appendix A. FINANCIAL IMPLICATIONS: None. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Resolution. STAKEHOLDER PROCESS: Not applicable to this Resolution. ALTERNATIVES: The City Council could not adopt this written policy and continue current procedures. RECOMMENDATION: Passage of the Resolution. ATTACHMENTS: None
