HomeMy WebLinkAbout10729ORDINANCE NO. 10729 AN ORDINANCE AMENDING TITLE XI, CHAPTER 4, OF THE PUEBLO MUNICIPAL CODE ABOLISHING THE REQUIREMENT THAT MINIATURE GOATS RESIDING IN THE CITY BE HORNLESS WHEREAS, City Council of the City of Pueblo desires to address concerns regarding the requirement that adult miniature goats be hornless in order to reside in the City; and WHEREAS, City Council determines that the requirement that miniature goats be hornless in order to reside in the City be abolished; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. Title XI, Chapter 4, Article III, Section 33 of the Pueblo Municipal Code is hereby amended as follows: (c) Notwithstanding anything to the contrary in Subsection (a) of this Section, it shall not be unlawful for any person to possess, harbor, keep or maintain not more than two (2) domesticated miniature goats upon any premises within the City. Domesticated miniature goats shall not exceed one hundred (100) pounds. Any such goats must be registered with the City Animal Shelter, neutered if over two (2) months old \[,\] and vaccinated\[, and hornless or debudded\]. Miniature goats must be licensed under P.M.C. Sections 11-4-43, 11-4-44, 11-4-45, and 11-4-46. The person possessing, harboring, keeping or maintaining the goat or goats must comply with all other provisions of this Chapter. SECTION 2. The officers and staff of the City are authorized and directed to perform any and all acts consistent with this Ordinance to implement the policies and procedures described herein. PREVIOUS COUNCIL ACTION: Council has previously acted by way of Ordinance 9903 to allow any person to possess not more than two (2) domesticated miniature goats within the City so long as the goats not exceed one hundred (100) pounds, be registered with the Pueblo Animal Shelter, neutered, vaccinated, and hornless or debudded. BACKGROUND: This issue came to the attention of Council due requirement that adult goats have their horns removed or baby goats be disbudded in order to be possessed in the City is potentially an inhumane practice. FINANCIAL IMPLICATIONS: None. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Ordinance. STAKEHOLDER PROCESS: None. ALTERNATIVES: status quo. RECOMMENDATION: Approve the Ordinance.
