HomeMy WebLinkAbout10724ORDINANCE NO.10724 AN ORDINANCE AMENDING ZONING RESTRICTIONS OF .85- ACRES OF THE SOUTHERN PORTION OF PARCEL B, OF THE TRINITY SUBDIVISION FROM B-3, HIGHWAY AND ARTERIAL BUSINESS ZONE DISTRICT TO S-1, GOVERNMENT USE ZONE DISTRICT BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The zoning restrictions covering the following described property, and in addition half of all adjacent dedicated roadway and alley rights-of-way, together generally identified in the attached Rezone Exhibit, is hereby changed from B-3, Highway and Arterial Business Zone District to S-1, Government Us Zone District: A parcel of land located in the northeast ¼ of the northwest ¼ of Section 33 Township 20 South, Range 64 West of the 6th Principal Meridian, in the County of Pueblo and State of Colorado, and being more particularly described as follows: Considering the south line of Parcel “B” of the Rearrangement of Property Boundaries recorded in Book 2155 at Page 979 in the Pueblo County records to bear S89°57’10”E and all bearings contained herein being relative thereto. Both ends of said south line being monumented with a No. 4 rebar with a 2” aluminum cap stamped with PLS. No. 31925. Beginning at the southeast corner of Parcel “A” in said Rearrangement of Property Boundaries, said point being on the north lot line of Lot 8, Block 2 in the Trinity Subdivision recorded June 12, 1981 in Book 2076 at Page 311 in the Pueblo County records; thence S89°57’10”E along said north line of Lot 8, a distance of 101.11 feet; thence S81°18’40”E, a distance of 65.14 feet; thence S48°46’22”E, a distance of 210.00 feet to the southeast corner of Lot 7, Block 2 of said Trinity Subdivision; thence S87°19’28”W along the south lot line of said Lot 7, a distance of 316.17 feet; thence N02°40’32”W, a distance of 163.26 feet to the Point of Beginning. Said parcel of land containing 0.85 acres, more or less. SECTION 2. The officers and staff of the City are authorized to perform any and all acts consistent with the intent of the Ordinance to implement the policies and procedures described herein. SECTION 3. This Ordinance shall become effective immediately upon final action by the Mayor and City Council. Ordinance re-adopted on a vote of ____________, on _____________ Council action on _______ failed to override the Mayor’s veto. ____________________________ President of City Council ATTEST ________________________________ City Clerk City Clerk's Office Item # S1 Background Paper for Proposed Ordinance COUNCIL MEETING DATE: June 10, 2024 TO: President Mark Aliff and Members of City Council CC: Mayor Heather Graham VIA: Marisa Stoller, City Clerk FROM: Scott Hobson, Acting Director Planning and Community Development SUBJECT: AN ORDINANCE AMENDING ZONING RESTRICTIONS OF .85-ACRES OF THE SOUTHERN PORTION OF PARCEL B, OF THE TRINITY SUBDIVISION FROM B-3, HIGHWAY AND ARTERIAL BUSINESS ZONE DISTRICT TO S-1, GOVERNMENT USE ZONE DISTRICT SUMMARY: The applicant is requesting to rezone .85-acres of the southern portion of Parcel B, of the Trinity Subdivision from B-3, Highway and Arterial Business Zone District to S-1, Government Use Zone District. PREVIOUS COUNCIL ACTION: On September 26, 2022, City Council approved Ordinance No.10279, approving the rezoning of land along highway 96 and west of Victory Lane from B-3, Highway and Arterial Business Zone District to S-1, Government Use Zone District. BACKGROUND: In September of 2022, Pueblo City Council approved the rezoning of 1.52-acres from a Highway and Arterial (B-3) Zone District to a Government Use (S-1) Zone District to facilitate the construction of Fire Station #6 (Z-22-09). However, in the plan development, it was determined that the fire station development would need to extend beyond the portion of the property that had been rezoned. A rearrangement of property boundaries, Trinity Subdivision Rearrangement of Property Boundaries (RPB-23-16) was filed to accommodate the additional land needed for the Fire Station 6 development. Therefore, the southern portion of Parcel B must be rezoned from B-3 to S-1 to create a uniformly zoned and consistent lot for the development. The new Fire Station #6, which will replace the existing Fire Station #6 (C-23-33), will provide facilities to isolate the truck room contaminants from the living quarters and cleaning facilities to allow fire fighters to decontaminate themselves properly. The new station will also include two full bays, a partial bay, office spaces, communal living, a kitchen, full bedrooms for up to eight firefighters, private bathrooms to accommodate all genders, and a gym space to work out. The proposed fire station will have modern architectural detailing and will be constructed on Parcel B (103,126 square feet) of the Trinity Subdivision Rearrangement of Property Boundaries. Development plans for Fire Station 6 were approved by the Planning and Zoning Commission on January 10, 2023 (GU-23-05) with the condition that the southern portion of the property be rezoned to S- 1, this request will fulfill the condition to rezone. FINANCIAL IMPLICATIONS: There are no financial implications for the City. BOARD/COMMISSION RECOMMENDATION: The Planning and Zoning Commission, at their May 8, 2024 Regular Meeting, voted 6-0 to recommend approval, Commissioner Maestri absent. STAKEHOLDER PROCESS: The Planning Department sent out Notice of the Planning and Zoning Commission Public Hearing to all property owners located within 300 feet of the subject property. A Public Notice poster was placed on the subject property 15 days prior to the Public Hearing. ALTERNATIVES: If City Council does not approve this Ordinance the property will not be zoned in accordance with the Pueblo Municipal Code. Upon request of City Council, the Ordinance could be returned to the Planning and Zoning Commission for consideration of proposed modifications. RECOMMENDATION: Approval of the Ordinance.
