HomeMy WebLinkAbout10711ORDINANCE NO. 10711 AN ORDINANCE APPROVING AND ACCEPTING A GRANT AGREEMENT BETWEEN THE CITY OF PUEBLO, A COLORADO MUNICIPAL CORPORATION, AND THE STATE OF COLORADO DEPARTMENT OF NATURAL RESOURCES, COLORADO PARKS AND WILDLIFE, FOR A LWCF GRANT PLAY FAIR PARK, AUTHORIZING THE MAYOR TO EXECUTE THE SAME, ESTABLISHING PROJECT NO. CI2441 - MINNEQUA LAKE TRAIL, BUDGETING AND APPROPRIATING FUNDS IN THE AMOUNT OF $875,000 TO PROJECT NO. CI2441 - MINNEQUA LAKE TRAIL, AND AUTHORIZING PAYMENT IN THE AMOUNT OF $875,000 FROM PROJECT NO. CI2113 - AMERICAN RESCUE PLAN ACT AS AUTHORIZED BY SECTION 603(C)(1) OF THE AMERICAN RESCUE PLAN ACT AND U.S. TREASURY FINAL RULE 31 CFR 35.6 BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Grant Award Letter (Intergovernmental Grant Agreement), CMS Number 190744, Municipal Corporation, from the State of Colorado Department of Natural Resources, Colorado Parks and Wildlife, for the LWCF project titled Play Fair Park, a copy of which is attached hereto, having been approved as to form by the City Attorney, is hereby approved. SECTION 2. The Mayor is hereby authorized to execute the Agreement in the name and on behalf of the City of Pueblo, where the Mayor may execute the Agreement by electronic signature and such electronic signature shall be attributable to the Mayor and the City of Pueblo. SECTION 3. Project Number CI2441 - Minnequa Lake Trail is hereby established. SECTION 4. The grant award from the State of Colorado Department of Natural Resources, Colorado Parks and Wildlife, totaling $875,000.00 is hereby approved and accepted in accordance with the Agreement. SECTION 5. All funds accepted pursuant to this Ordinance shall be budgeted and appropriated into Project Number CI2441 - Minnequa Lake Trail. Said funds shall only be expended and used for this project. SECTION 6. The transfer of funds in the amount of $875,000 is hereby authorized from Project CI2113 American Rescue Plan Act for the development of Play Fair Park. SECTION 7. Pursuant to the Agreement, the State of Colorado Department of Natural Resources, Colorado Parks and Wildlife, may unilaterally amend the terms or the amount of grant funds pursuant to an Option Letter or Grant Funding Change Letter. In the event the State increases the grant award via such a letter, the additional funds may be accepted pursuant to this Ordinance and budgeted and appropriated into Project Number CI2441 Minnequa Lake Trail, where said funds shall only be expended and used for this project. SECTION 8. The officers and staff of the City are authorized to perform any and all acts consistent with the intent of this Ordinance to implement the policies and procedures described herein. SECTION 9. This Ordinance shall become effective on the date of final action by the Mayor and City Council. CI2113 - AMERICAN RESCUE PLAN ACT AS AUTHORIZED BY SECTION 603(C)(1) OF THE AMERICAN RESCUE PLAN ACT AND U.S. TREASURY FINAL RULE 31 CFR 35.6 SUMMARY: This Ordinance approves and accepts a grant agreement from the State of Colorado Department of Natural Resources, Colorado Parks and Wildlife, for a Land, Water, Conservation Fund (LWCF) Grant to construct an accessible paved trail around Lake Minnequa. PREVIOUS COUNCIL ACTION: Not applicable to this Ordinance. BACKGROUND: In 2009, the City purchased Lake Minnequa from the steel mill and began developing the regional stormwater detention facility into a Community Park that would benefit the entire community. Initially, the trail was developed with gravel, but with time has become difficult to maintain as an ADA accessible path. The award of the funds will allow the City to renovate and upgrade the existing trails with new concrete trails. This new surface will provide accessible routes to the fishing dock, playground area, restroom and concession, basketball / pickleball courts, sports fields, exercise equipment, and parking lots. FINANCIAL IMPLICATIONS: The total $1,750,000 in funds are from grants for this project. No City general fund monies will be used for this project. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Ordinance. STAKEHOLDER PROCESS: Not applicable to this Ordinance. ALTERNATIVES: Not accepting these funds would likely result in inaccessible access to the many RECOMMENDATION: Approval of the Ordinance. ATTACHMENTS: 1.
