HomeMy WebLinkAbout15641RESOLUTION NO. 15641 A RESOLUTION APPROVING AMENDMENT NO. 3 TO THE AGREEMENT FOR PROFESSIONAL ARCHITECTURAL SERVICES IN THE AMOUNT OF $59,025 BETWEEN THE CITY OF PUEBLO, A COLORADO MUNICIPAL CORPORATION, AND ALLRED AND ASSOCIATES, A COLORADO CORPORATION., FOR PROJECT NO. 22-010 DESIGN AND ENGINEERING OF NEW FIRE STATIONS 6, 8, AND 11 PROJECT, AND AUTHORIZING THE PURCHASING AGENT TO EXECUTE SAME. WHEREAS, an Agreement for Professional Architectural Services was awarded to Allred and Associates, on July 12, 2022, and, WHEREAS, Amendment No. 1 to the Agreement for Professional Architectural Services was awarded to Allred and Associates on September 28, 2022, and, WHEREAS, Amendment No. 2 to the Agreement for Professional Architectural Services was awarded to Allred and Associates on October 13, 2023, and, WHEREAS, the City of Pueblo and Allred and Associates, desire to modify the Agreement for additional services; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that SECTION 1. Amendment 3 to the Agreement for Professional Architectural Services for Project No. 22-010 Design and Engineering of New Fire Stations 6, 8, and 11 Project, by and between the City of Pueblo, a Municipal Corporation, and Allred and Associates, Inc., a Colorado Corporation, a copy of which is attached hereto, having been approved as to form by the City Attorney, is hereby approved, and City Council authorizes the additional work contemplated by the Amendment to be performed in the amount of $59,025.00. SECTION 2. Funds in the amount of $59,025.00 shall be paid from Project Account CI2435 Fire Stations 6, 8 and 11 Project. SECTION 3. The Purchasing Agent is hereby authorized to execute said Amendment on behalf of the City of Pueblo, a Colorado Municipal Corporation, and the City Clerk shall affix the seal of the City thereto and attest same. SECTION 4. The officers of the City of Pueblo are authorized to perform any and all acts consistent with this Resolution and the attached Amendment to implement the policies and procedures described herein. SECTION 5. This Resolution shall become effective immediately upon passage and approval. SUMMARY: This Resolution approves Contract Amendment No. 3 to the Agreement for Professional Architectural Services awarded to Allred And Associates, in the amount of $59,025.00 for Project No. 22-010, Design and Engineering of New Fire Stations 6, 8, and 11. PREVIOUS COUNCIL ACTION: Ordinance 10110, dated February 14, 2022, established Fire Station 6, 8, and 11 Project and Project Account CI2205, transferred $600,000.00 from the unappropriated fund balance of the general fund, and budgeted and appropriated $600,000.00. Ordinance 10188, dated June 13, 2022, transferred $609,245.00 from the unappropriated fund balance of the general fund, and budgeted and appropriated $609,245.00. Ordinance, 10202, dated June 27, 2022, transferred $270,000.00 from the "2022" unappropriated fund balance of the general fund, and budgeted and appropriated $270,000.00. Resolution 14938, dated July 11, 2022, awarded an agreement for Professional Design Services to Allred and Associates for Design and Engineering services of new Fire Stations 6, 8, and 11. On October 23, 2023, by Ordinance No. 10570, City Council authorized a site lease and lease purchase agreement between the City, and BOKF, N.A. (solely in its capacity as trustee) for the purpose of financing the construction, improvement, and equipping of three fire stations by issuing Series 2023 Certificates of Participation to not exceed $37,000,000. On January 22, 2024, by Ordinance No. 10640, City Council authorized the establishment of the Debt Service Fund No. 304 - COP-Fire Stations. On March 11, 2024, by Ordinance No. 10670, City Council authorized the establishment of the Capital Projects Fund No. 456 Fire Stations, budgeted and appropriated the proceeds received from the issuance of the Series 2023 Certificates of Participation and all future funds received into Fund No. 456. Pending approval on May 13, 2024 City Council agenda establishes Project CI2435 - Fire Station No. 6, 8, and 11 in Fund 456 - Fire Stations. BACKGROUND: This project is part of infrastructure and response improvements for the City of Pueblo and its Fire Departments, relocating Fire Stations 1, 6, and 8, and building a new Fire Station 11. In April 2022, the City of Pueblo solicited Requests for Proposals (RFP 22-010) for design and engineering services for new Fire Stations 6, 8, and 11. A total of nine (9) firms provided a proposal for the work. City Staff provided evaluations of the proposals using project approach, work schedule, fee schedule and statement of qualifications evaluation criteria. Upon compilation of staff evaluations, the top five (5) firms were interviewed. Allred and Associates was then chosen by the interview committee. Amendment No. 1 to the Professional Architectural Services Agreement, approved by the Director of Purchasing, due to the amount of change being less than 10% of the overall contract amount, was for additional redesign survey work. Amendment No. 2 to the Professional Architectural Services Agreement, also approved by the Director of Purchasing, was for additional testing bore holes and reporting for geothermal. The design was completed in December 2023, and the Information for Bid for the construction of the new fire stations was published to the three (3) pre-qualified contractors in January 2024. Bids received from the contractors were significantly over budget, so a process of value engineering was started. In order to provide a complete set of plans with the changes made during value engineering, additional funding is required in the contract with the architect. FINANCIAL IMPLICATIONS: Funding in the amount of $59,025.00 will be paid from Project Account CI2436, Fire Stations 6, 8, and 11 Project. BOARD/COMMISSION RECOMMENDATION: None. STAKEHOLDER PROCESS: None. ALTERNATIVES: Denial of this Resolution will result in the cancelation of additional services. However, the additional services are necessary to provide a final set of documents to the contractor for construction of the fire stations. RECOMMENDATION: Approval of the Resolution.
