CI- 2113 AMERICAN RESCUE PLAN ACT, FOR THE PURPOSES OF ALIGNING ALL HARDWARE AND SOFTWARE LICENSING, WARRANTY AND TECHNICAL SUPPORT SERVICES, AND CERTIFICATION TRAINING, AND ADDING SITUATIONAL AWARENESS CAMERAS TO THE REAL-TIME CRIME CENTER, AS AUTHORIZED BY SECTION 603 (A) OF THE AMERICAN RESCUE PLAN ACT AND U.S. TREASURY FINAL RULE 31 CFR 35 WHEREAS, on March 11, 2021, President Biden signed the U.S. Senate-amended H.R. 1319 (P.L. 117- WHEREAS, on May 10, 2021, the U.S. Treasury issued the Interim Final Rule to implement WHEREAS, by Ordinance No. 9931, approved on May 17, 2021, the City Council established Project No. CI-2113 and budgeted and appropriated up to $36.7 million in funds which were expected to be distributed to the City from ARPA for covered costs and eligible expenses to be incurred during the period which began on March 3, 2021, until December 31, 2024 (to be expended by December 31, 2026); and WHEREAS, on January 6, 2022, the U.S. Treasury issued, with an effective date of April 1, 2022, the Final Rule to implement ARPA in Title 31, Part 35 of the CFR; and WHEREAS, under the Final Rule, recipients may use Coronavirus State and Local Fiscal Recovery Funds (COVID-19 public health emergency and the negative economic consequences resulting therefrom; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that SECTION 1. Payment in the amount of eight hundred thirty-four thousand one hundred and forty-four dollars ($834,144) is hereby authorized from Project CI2113 American Rescue Plan for the purpose of aligning all hardware and software licensing, warranties, certification training, and technical support services for all components of the Real-Time Crime Center, and the purchase and installation of additional situational awareness cameras. SECTION 2. The officers and staff of the City are authorized to perform all acts consistent with this Resolution to implement the policies and procedures described herein. SECTION 3. This Resolution shall become effective immediately upon final passage. CI-2113 AMERICAN RESCUE PLAN ACT, FOR THE PURPOSES OF ALIGNING ALL HARDWARE AND SOFTWARE LICENSING, WARRANTY AND TECHNICAL SUPPORT SERVICES, AND CERTIFICATION TRAINING, AND ADDING SITUATIONAL AWARENESS CAMERAS TO THE REAL- TIME CRIME CENTER, AS AUTHORIZED BY SECTION 603 (A) OF THE AMERICAN RESCUE PLAN ACT AND U.S. TREASURY FINAL RULE 31 CFR 35 SUMMARY: This Resolution authorizes the payment of $834,144 in American Rescue Plan Act warranty, certification training, and technical support services for all components of the Real-Time Crime Center (RTCC). In addition, situational awareness cameras will be added and installed with the license-plate readers which have been previously implemented. PREVIOUS COUNCIL ACTION: By Ordinance No. 9931, approved on May 17, 2021, the City Council established Project No. CI-2113 and budgeted and appropriated up to $36.7 million in funds which were expected to be distributed to the City from the American Recovery Plan Act d during the period which began on March 3, 2021, until December 31, 2024, (to be expended by December 31, 2026). BACKGROUND: The City Council approved one-point-five million ($1,500,000) dollars to fund a real-time crime center (RTCC) for the City of Pu Another one-hundred and fifty thousand ($150,000) was added for cybersecurity and backup. In analyzing the different hardware and software components of the RTCC, it was determined all the hardware and software licensing, warranty, and technical support services did not align to the same technical maintenance and support renewal period. This creates a risk that a component, service, or warranty would not be covered when a system down or other event occurred thus preventing technical support or component replacements from being available immediately. As a mission-critical system supporting public safety, it is imperative that all components are always under the appropriate technical support, licensing, and support services. To eliminate the risk of human-error on a renewal period for any of the components, the Information Technology Department analyzed the purchases and received pricing to align all aspects of the system to the 5-year warranty term of the hardware and software already purchased. Police Department and Information Technology Department personnel must complete a training course and become certified to support and administer the RTCC. The cost for training up to ten (10) personnel is included in the $834,144. Further, the Pueblo Police Department determined that the information being obtained from the fixed license-plate readers (LPR) could be enhanced with the addition of situational awareness cameras within the same vicinity of the LPR units. The addition of these cameras will increase the possibility of obtaining photo evidence of criminal activity that occurs within that area. The cost of these cameras is included in the $834,144. Because crime rates have increased and public safety staffing has decreased during the COVID-19 Pandemic, it is imperative that the RTCC is implemented with care and its functionally protected due to its complexity and importance to the operations of the Pueblo Police Department and the safety of our citizens. The costs associated for warranty, training, technical support, services, and software licensing related to the protect mission critical public safety applications is an eligible use of ARPA funds 31C.F.R. 35.6(b)(3)(ii)(E)(4). FINANCIAL IMPLICATIONS: Funding in the amount of $834,144 will be paid out of Project Cl2113 - American Rescue Plan. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Resolution. STAKEHOLDER PROCESS: Not applicable to this Resolution. ALTERNATIVES: The City Council could decide not to support or fund the technical needs and services required by the RTCC system exposing it to catastrophic failure and compromising public safety services and calls for service for our citizens.
