HomeMy WebLinkAbout15632RESOLUTION NO. 15632 A RESOLUTION APPROVING AN ENVIRONMENTAL COVENANT DEED RESTRICTION ON CERTAIN PORTION OF THE LAKE MINNEQUA EXPANSION PROJECT BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that SECTION 1. The Deed Restriction on Certain Portion of Lake Minnequa Expansion Project Environmental Covenant dated May 13, 2024, from the United States Army Corps of Engineers, a copy of which is attached hereto, having been approved by the Assistant City Attorney, is hereby accepted and approved. The Mayor is hereby authorized and directed to execute same for and on behalf of the City and the City Clerk is directed to affix the seal of the City thereto and attest same. SECTION 2. The officers and staff of the City are authorized to perform any and all acts consistent with the intent of this Resolution which are necessary or desirable to implement the transactions described herein. SECTION 3. This Resolution shall become effective immediately upon final passage. BACKGROUND: In the past several years, the City has built many recreational and stormwater de up of approximately 50 acres of lake surface with many adjacent wetlands, which are under the jurisdiction of the United Sates Army Corps of Engineers Nationwide Permit 42. ated location. The Parks and Recreation Department is about to complete the construction of the wetland. The environmental covenant is a requirement of our permit that will protect, preserve, and maintain the wetland and its condition in perpetuity. FINANCIAL IMPLICATIONS: Not applicable to this Resolution. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Resolution. STAKEHOLDER PROCESS: Not applicable to this Resolution.
