A RESOLUTION RATIFYING AN EMERGENCY
CONSTRUCTION CONTRACT IN THE AMOUNT OF $92,526.71
WITH PARKER EXCAVATING, INC. FOR EMERGENCY
SANITARY SEWER POINT REPAIR AT 118 E ADAMS AVE,
PROJECT NO. 20-059 (WWAN03) AND APPROVING THE
XECUTION OF THE SAME
WHEREAS, an emergency sanitary sewer repair was authorized by the Mayor in
accordance with Pueblo Purchasing Policy Section 3.2.2 (6); and
WHEREAS, the point repair work was awarded to Parker Excavating, Inc., under the
2021-2023 multi-year point repair contract; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that
SECTION 1.
City Council ratifies and approves the contract for repair of the sanitary sewers at 118 E
Adams Ave with Parker Excavating, Inc., Project No. 20-059 (WWAN03) awarded to said bidder
in the amount of $92,526.71.
SECTION 2.
Funds for Project 20-059 shall be from the Sewer User Fund (WWAN03).
SECTION 3.
The Purchasing Agent was authorized to execute said contract on behalf of Pueblo, a
Colorado Municipal Corporation, and the City Clerk properly affixed the seal of the City thereto
and attested the same.
SECTION 4.
The officers and staff of the City are authorized to perform any and all acts consistent
with the intent of this Resolution and the contract to implement the transactions described
therein. Furthermore, all actions previously taken by officers and staff of the City consistent with
the contract including any payments authorized under the contract and the contract change
order in the amount of $28,120.71 are hereby ratified.
SECTION 5.
This Resolution shall become effective immediately upon passage and approval.

SUMMARY:
This Resolution ratifies and approves the award of a construction contract to Parker
Excavating, Inc. for emergency sanitary sewer point repairs at 118 E Adams Ave.
PREVIOUS COUNCIL ACTION:
None
BACKGROUND:
On December 29, 2023, the Streets Department contacted the Wastewater Department
about a sinkhole forming at 118 E Adams Avenue. A television crew was sent out to
inspect the main and they discovered a defective capped service at the sinkhole
location that was allowing dirt and rocks to enter the main. They also discovered
multiple defective capped services and holes in this pipe segment that will eventually
cause the same issue as well as increasing the chance of immediate backups into
private properties due to obstructions in the main. An emergency repair is necessary to
repair the defective pipe segment, so a backup would not occur.
The repair work was performed under the Sanitary Sewer Point Repair multi-year
contract under which three contractors were qualified via competitive bid. An estimate
was prepared, and Parker Excavating was the lowest bidder and accepted the work.
The cost breakdown for the project is as follows:

FINANCIAL IMPLICATIONS:
Funding for this project came from the sanitary sewer rehabilitation budget funded by
the Sewer User Fund. Funding was available and had been budgeted, appropriated,
and allocated to Project No. 20-059 (WWAN03).

ALTERNATIVES:
Not approve the Resolution, but this would require a finding that there was not an
emergency condition.
