HomeMy WebLinkAbout10697ORDINANCE NO. 10697 AN EMERGENCY ORDINANCE AMENDING ORDINANCE NO. 10582 AUTHORIZING THE MAYOR TO DECLARE TEMPORARY HOUSING AND SHELTER EMERGENCIES AS NECESSARY THROUGHOUT THE YEAR FOR HOMELESS RESIDENTS OF THE CITY OF PUEBLO WHEREAS, the City is experiencing an increase in the number and intensity of instances of fire, flooding, heat, cold, and other natural disaster; and WHEREAS, the City is also experiencing an increase in man-made circumstances resulting an increase in the number of unhoused, as well as other exigent circumstance which pose signific WHEREAS, there is a need for temporary overnight shelters outside the current BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The City of Pueblo hereby declares that a housing and shelter emergency currently s do not have current access to appropriate overnight shelters to protect their health and safety against dangerous weather events or man-made circumstances when they are outdoors. SECTION 2. Ordinance No. 10058, dated November 22, 2021, shall be hereby expanded, enlarged, and amended to allow the Mayor to declare temporary housing and shelter emergencies for the cold, natural disaster, man-made circumstances, influx of unhoused, and any other exigent circumstance or existential threat to the unhoused community, at any time, as determined by the Mayor. SECTION 3. Except as amended hereby, Ordinance No. 10058, as previously amended, is hereby ratified, and shall remain in full force and effect. SECTION 4. The immediate enactment of this Ordinance is necessary to preserve and protect the health, safety, and welfare of the residents of the City. Pursuant to Section 3-20 of the City Charter, this Ordinance shall become effective on the date of final action by the Mayor and City Council. SECTION 5. The officers and staff of the City are authorized and directed to perform any and all acts consistent with this Ordinance to implement the policies and procedures described herein. PREVIOUS COUNCIL ACTION: On November 22, 2021, by Ordinance No. 10058, City Council authorized the Mayor, when temperatures reach dangerous levels between December 1st and March 31st of es, synagogues, mosques, temples, and other religious institutions to be used as temporary warming and Building Code ordinances and regulations in conflict with such use were temporarily suspended during such temporary emergencies. On November 14, 2022, by Ordinance 10326, City Council enlarged this authority from December 1st to November 1st. On October 23, 2023, by Ordinance No. 10582, City Council ex st authority to declare a housing and shelter emergency before November 1 of each year. BACKGROUND: The City is experiencing an increase in the frequency of extreme weather events to include fire, flooding, heat, and cold in addition to certain man-made circumstances and unhoused residents outside of the current emergency housing and shelter authorization. FINANCIAL IMPLICATIONS: On October 24, 2022, by Ordinance 10305, City Council approved and authorized the Mayor to sign a Subrecipient Agreement the Crazy Faith Street Ministry, a Colorado homeless shelter when temporary housing and shelter emergencies are declared by the Mayor. The attached ordinance could lead CFSM to request an increase in the number of approved overnights beyond the currently approved 20 overnights.
