AN ORDINANCE AMENDING SECTION 17-2-2(84) OF
CHAPTER 4 OF TITLE XVII OF THE PUEBLO MUNICIPAL
CODE RELATING TO THE USE DEFINITION OF A
MANUFACTURED HOME, ONE-FAMILY

BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
Section 17-2-2 (84) of the Pueblo Municipal Code is hereby amended to read as follows:
Sec. 17-2-2. Use definitions

(84) Manufactured home, one-family means a single-family dwelling which:
a. Is partially or entirely manufactured in a factory;
\[b.\] \[Is not less than twenty-four (24) feet in width and thirty-six (36) feet in length;\]
\[c.\] b. Is designed for and placed upon an engineered \[permanent\] foundation;
\[d.\] c. Has brick, wood or cosmetically equivalent exterior siding on all exterior walls which
provides a consistent, continuous facade from the bottom of the soffit (top of wall section)
downward to the exposed perimeter wall, foundation or to grade, whichever is applicable, and
has a pitched roof; and
\[e.\] d. Is manufactured after 1976 and certified pursuant to the National Manufactured Housing
Construction and Safety Standards Act of 1974, 42 U.S.C. § 5401 et seq., as amended
(commonly referred to as the "HUD" Code; effective in 1976) and all regulations enacted
pursuant thereto, including any local modifications that are expressly allowed by federal law, or
which have been certified by the State as being in compliance with the requirements of the
\[Uniform Building Code\]
\[as adopted by the State and enforced and administered by the Colorado Division of Housing.\]
SECTION 2.
The officers and staff of the City are authorized to perform any and all acts consistent
with the intent of the Ordinance to implement the policies and procedures described herein.
SECTION 3.
This Ordinance shall become effective thirty (30) days after the date of final action by the
Mayor and City Council.

SUBJECT: AN ORDINANCE AMENDING SECTION 17-2-2(84) OF CHAPTER 4 OF
TITLE XVII OF THE PUEBLO MUNICIPAL CODE RELATING TO THE
USE DEFINITION OF A MANUFACTURED HOME, ONE-FAMILY
SUMMARY:
Attached for consideration is an Ordinance that amends Section 17-2-2 (84) of Chapter
4 of the Pueblo Municipal Code relating to the definition of a manufactured home, one
family, that follows Manufactured Housing Construction and Safety Standards.
PREVIOUS COUNCIL ACTION:
None.
BACKGROUND:
than twenty-four (24) feet in width and thirty-
minimum 864 sq. ft. manufactured residential structure. The current minimum size and
structure dimensions limits the ability to place different sized manufactured and modular
homes on single family lots even when they are built to HUD and IBC standards.
Manufactured homes have evolved in the last several years, resulting in a multitude of
residences that are wholly or partially constructed in a factory, which includes
manufactured homes, modular homes, panelized homes, and pre-cut homes.
Manufactured homes are constructed to HUD standards; however, the other types of
factory-built homes are often built to standard building codes adopted by the State of
Colorado specifically for residences constructed in a factory. These homes are required
to be placed o
placement standards, Section 17-4-11 of the Pueblo Municipal Code. Current demand
trends show a need for smaller, affordable, and alternate designs in this building type.
Increased flexibility in the code allows the Planning Department the tools to work with
developers to increase housing stock while maintaining appropriate design standards.
FINANCIAL IMPLICATIONS:
There are no financial implications for the City.
BOARD/COMMISSION RECOMMENDATION:
The Planning and Zoning Commission, at their March 13, 2024, Regular Meeting, voted
7-0 to recommend approval.
STAKEHOLDER PROCESS:
The Planning Department sent out Notice of the Planning and Zoning Commission
Public Hearing by publication of the proposed amendment fifteen (15) days prior to the
Public Hearing.
ALTERNATIVES:
If City Council does not approve this Ordinance, Section 17-2-2 (84), relating to the use
definition of Manufactured Home, one-family, will remain.
Upon request of City Council, the Ordinance could be returned to the Planning and
Zoning Commission for consideration of proposed modifications.
RECOMMENDATION:
Approval of the Ordinance.
