HomeMy WebLinkAbout15581RESOLUTION NO. 15581 A RESOLUTION APPROVING AN AGREEMENT IN AN AMOUNT NOT TO EXCEED $87,770 BETWEEN THE CITY OF PUEBLO AND BROWN AND CALDWELL, INC., FOR PROFESSIONAL SERVICES EVALUATING AND DEVELOPING PRETREATMENT LOCAL LIMITS AND AUTHORIZING THE MAYOR TO EXECUTE THE SAME WHEREAS, the City of Pueblo owns, operates, and maintains a wastewater system subject to the requirements of the Federal Clean Water Act and the Colorado Water Quality Control Act; and WHEREAS, to protect the wastewater system, the City of Pueblo implements local limits through an approved pretreatment program; and WHEREAS, the pretreatment local limits may require period evaluation and development to remain protective of the wastewater system; and WHEREAS, Brown and Caldwell, Inc. is the Engineer of Record for the James R. DiIorio Water Reclamation Facility, they will provide professional services; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that SECTION 1. The Agreement for Professional Services by and between Pueblo, a Colorado Municipal Corporation, and Brown and Caldwell, Inc., a true copy of which is attached hereto and incorporated herein by reference (the “Agreement”) having been approved as to form by the City Attorney, is hereby approved. SECTION 2. Funds for payment for professional services under said Agreement in an amount not to exceed $87,770 shall be paid from appropriated funds budgeted in the City’s 2024 Budget from the Sewer User Fund, Professional Services. SECTION 3. The officers and staff of the City of Pueblo are authorized to perform any and all acts consistent with the intent of this Resolution and to implement the transaction herein authorized. SECTION 4. This Resolution shall become effective immediately upon passage and approval. The agreement will ensure that the pretreatment local limits are protective of the sanitary sewer system and water reclamation facility from industrial and other nondomestic discharges. PREVIOUS COUNCIL ACTION: Resolution No. 15497 awarded an agreement between the City of Pueblo and Brown and Caldwell, Inc., to provide engineering services for the Pueblo Wastewater Department, on February 12, 2024 BACKGROUND: The Wastewater Department has administered an EPA approved Pretreatment Program since 1984. The Pretreatment Program is responsible for regulation of industrial and nondomestic discharges to the sanitary sewer system to protect infrastructure, wastewater personnel, and reduce conventional and toxic pollutant levels discharged by industries and other nondomestic wastewater sources into the City’s sanitary sewer system.. Local limits are intended to protect the needs specific to our City’s sewer system and water reclamation facility, and the receiving waters. These limits require periodic evaluation to ensure that they are protective. The purpose of this project is to review the local limits to ensure that they are protective of our system. This agreement between the City of Pueblo and Brown and Caldwell, Inc. authorizes Brown and Caldwell, Inc. to evaluate and develop pretreatment local limits for the Wastewater Department to ensure protection of the wastewater system. FINANCIAL IMPLICATIONS: Funds for this project are available from the Sewer User Fund and have been appropriated in the Sewer User Fund, Professional Services. BOARD/COMMISSION RECOMMENDATION: None STAKEHOLDER PROCESS: None ALTERNATIVES: The no-approval alternative is to forego evaluation of current local limits. If current local limits are not applicable to controllable discharges or are not protective of the wastewater system, there is potential for violations of the water reclamation facility’s discharge permit. RECOMMENDATION: Approval of the Resolution.
