HomeMy WebLinkAbout10679ORDINANCE NO. 10679 AN ORDINANCE APPROVING A SPECIAL AREA PLAN FOR THE QUIKTRIP 4298, SUBDIVISION FILING NO. 1 WHEREAS, a request for a Special Area Plan for the QuikTrip 4298, Subdivision Filing No. 1, A Special Area Plan, has been submitted to the Planning and Zoning Commission for approval pursuant to Section 17-4-29 of the Pueblo Municipal Code, and, WHEREAS, the Planning and Zoning Commission after a public hearing found and determined the objectives and requirements of said Section 17-4-29 can and will be met, and, WHEREAS, the Planning and Zoning Commission has recommended the approval of the Special Area Plan for QuikTrip 4298, Subdivision Filing No. 1, A Special Area Plan, NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. Ordinance re-adopted on a vote of ____________, on _____________ ____________________________ President of City Council ATTEST ________________________________ City Clerk City Clerk's Office Item # S2 Background Paper for Proposed Ordinance COUNCIL MEETING DATE: March 25, 2024 TO: President Mark Aliff and Members of City Council CC: Mayor Heather Graham VIA: Marisa Stoller, City Clerk FROM: Scott Hobson, Acting Director Planning and Community Development SUBJECT: AN ORDINANCE APPROVING A SPECIAL AREA PLAN FOR THE QUIKTRIP 4298, SUBDIVISION FILING NO. 1 SUMMARY: The applicant is requesting approval of a Special Area Plan for the QuikTrip 4298, Subdivision, Filing No. 1 which will re-subdivide Parcel A, 28.36-acres, as amended by RPB-22-04 into four commercial lots and three parcels, to facilitate the development of a QuikTrip Convenience Store and future commercial development. The lots will be accessed by private roads, Tracts B (extension of Streator Avenue) and C (extension of Reno Avenue), which require a Special Area Plan. PREVIOUS COUNCIL ACTION: The applicant is concurrently requesting to re-subdivide Parcel A, 28.36-acres, (S-22- 11) and is also requesting a Commercial Plan Review (C-22-26). BACKGROUND: The proposed QuikTrip Convenience Store will be located on Lot 1 and will have a frontage on Lake Avenue. All lots will be accessed from internal private streets; therefore, a Special Area Plan is being proposed in conjunction with the subdivision to allow the proposed private streets. Lots 2-4 will be reserved for future commercial development. The applicant submitted landscape plans for the entire site, and a sign plan with details as part of the Special Area Plan. Staff are requiring landscaping for Tract A, Drainage Easement, the landscaping requirement must be addressed in the form of an SAP Plat Statement as conditioned below. The applicant is proposing a multi-tenant sign to be located on Lot 4 adjacent to Pueblo Boulevard. A Master Sign Plan, approved by the Planning and Zoning Commission, will be required to allow the proposed off-site multi-tenant sign. Sheets 2-7 of the SAP submittal (landscaping and signs) are not applicable to the SAP review and approval; and will not be recorded with the Subdivision and Special Area Plan. FINANCIAL IMPLICATIONS: None. BOARD/COMMISSION RECOMMENDATION: The Planning and Zoning Commission, at their April 12, 2023 Regular Meeting, voted 7- 0 to recommend approval. STAKEHOLDER PROCESS: The Planning Department sent out Notice of the Planning and Zoning Commission Public Hearing to all property owners located within 300 feet of the subject property. A Public Notice poster was placed on the subject property 15 days prior to the Public Hearing. ALTERNATIVES: If City Council does not approve this Ordinance, a Special Area Plan will not be created. Upon request of City Council, the Ordinance could be returned to the Planning and Zoning Commission for consideration of proposed modifications. RECOMMENDATION: Approval of the Ordinance.
