HomeMy WebLinkAbout10658ORDINANCE NO. 10658 AN ORDINANCE APPROVING A COOPERATION AGREEMENT BETWEEN THE CITY OF PUEBLO, A COLORADO MUNICIPAL CORPORATION, AND THE COUNTY OF PUEBLO RELATING TO THE ADMINISTRATION OF TENANT BASED RENTAL ASSISTANCE IN ACCORDANCE WITH THE FEDERAL HOME INVESTMENT PARTNERSHIPS PROGRAM REQUIREMENTS AND AUTHORIZING THE MAYOR TO EXECUTE SAME BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Tenant Based Rental Assistance Agreement between the City of Pueblo, a th Colorado Municipal Corporation, and the County of Pueblo dated February 26, 2024 (“Agreement”), relating to the administration of the Tenant Based Rental Assistance Program utilizing Federal HOME Investment Partnerships Program funding, incorporated herein and attached hereto, having been approved as to form by the City Attorney, is hereby approved. SECTION 2. The Mayor is hereby authorized to execute the Agreement on behalf of the City, and the City Clerk shall affix the Seal of the City thereto and attest the same. SECTION 3. The officers and staff of the City are authorized to perform any and all acts consistent with this Ordinance to implement the policies and procedures described herein. SECTION 4. This Ordinance shall become effective immediately upon final passage and approval. Action by City Council: Introduced and initial adoption of Ordinance by City Council on February 12, 2024. President of City Council ATTEST City Clerk City Clerk's Office Item # R5 Background Paper for Proposed Action Item COUNCIL MEETING DATE: February 26, 2024 TO: President Mark Aliff and Members of City Council CC: Mayor Heather Graham VIA: Marisa Stoller, City Clerk FROM: Scott Hobson, Acting Director Planning and Community Development SUBJECT: AN ORDINANCE APPROVING A COOPERATION AGREEMENT BETWEEN THE CITY OF PUEBLO, A COLORADO MUNICIPAL CORPORATION, AND THE COUNTY OF PUEBLO RELATING TO THE ADMINISTRATION OF TENANT BASED RENTAL ASSISTANCE IN ACCORDANCE WITH THE FEDERAL HOME INVESTMENT PARTNERSHIPS PROGRAM REQUIREMENTS AND AUTHORIZING THE MAYOR TO EXECUTE SAME SUMMARY: The intergovernmental agreement between the City of Pueblo and the County of Pueblo for a joint effort to undertake a Tenant Based Rental Assistance activity utilizing Federal HOME Investment Partnerships Act funding to provide rental assistance for individuals and families at-risk of becoming homeless and transition currently homeless individuals to stable housing. PREVIOUS COUNCIL ACTION: No previous Council action has been taken. BACKGROUND: The City of Pueblo and Pueblo County, since the inception of the federal HOME Program in 1992, have operated under a Consortium agreement whereby the HOME funds have been shared on a percentage basis. While the City of Pueblo is the Entitlement Community, there have been mutual benefits in continuing this administrative arrangement. The City as the Participating Jurisdiction acts in a representative capacity, and therefore assumes overall responsibility for ensuring that the Consortium’s HOME Program (City and County programs) is carried out in compliance with the requirements of the HOME Program regulations, including requirements concerning a Consolidated Plan. Collaboratively administering the TBRA program will streamline the operation of the program and consolidate future monitoring responsibilities. The City assumes this responsibility. Pueblo County authorizes the City to expend their HOME funds, located in Project account No. HO2130 in the amount of $66,978.83, along with the required HOME match of $22,326.17 due from the County. FINANCIAL IMPLICATIONS: With approval of this ordinance, the City will expend $100,000 in HOME program funds on the TBRA activity along with an additional $89,305 from Pueblo County for a total funding amount of $189,305. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Ordinance. STAKEHOLDER PROCESS: Not applicable to this Ordinance.
