CI2113 - AMERICAN RESCUE PLAN ACT, FOR THE PURPOSES OF PURCHASING THE PROPERTY KNOWN AS 2701 EAST 12TH STREET, PUEBLO, CO, PERFORMING CERTAIN PROPERTY BOUNDARY CHANGES, PERFORMING CERTAIN IMPROVEMENTS, AND AUTHORIZING THE MAYOR TO EXECUTE ANY REQUIRED DOCUMENTS, AS AUTHORIZED BY SECTION 603 (A) OF THE AMERICAN RESCUE PLAN ACT AND U.S. TREASURY FINAL RULE 31 CFR 35 RECITALS The following recitals are incorporated in and made part of this Resolution: WHEREAS, on March 11, 2021, President Biden signed the U.S. Senate-amended H.R. 1319 (P.L. 117-2) known as the American Rescue Plan Act ("ARPA"); and WHEREAS, on May 10, 2021, the U.S. Treasury issued the Interim Final Rule to implement ARPA in Title 31, Part 35 of the Code of Federal Regulations (C"Cfr"); and WHEREAS, by Ordinance No. 9931, approved on May 17, 2021, the City Council established Project No. CI2113 and budgeted and appropriated up to $35.7 million in funds which were expected to be distributed to the City from ARPA for covered costs and eligible expenses to be incurred during the period which began on March 3, 2021, until December 31, 2024 (to be expended by December 31, 2026): and WHEREAS, on January 6, 2022, the U.S. Treasury issued, with an effective date of April 1, 2022, the Final Rule to implement ARPA in Title 31, Part 35 of the CFR; and WHEREAS, under the Final Rule, recipients may use Coronavirus State and Local Fiscal Recovery Funds ("SLFRF") to respond to the COVID-19 public health emergency and the negative economic consequences resulting therefrom; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that SECTION 1. Funds in the amount of one hundred eighty thousand dollars ($180,000) are hereby authorized for payment from Project No. CI2113 – American Rescue Plan Act, for purposes of of acquiring the property known as 2701 East 12th Street, Pueblo, Co, performing certain property boundary changes and performing certain improvements to the property. SECTION 2. The Mayor is hereby authorized to execute any and all necessary documents to facilitate the purchase of 2701 East 12th Street, Pueblo, Colorado. SECTION 3. The officers and staff of the City are authorized to perform all acts consistent with this Resolution to implement the policies and procedures described herein. SECTION 4. This Resolution shall become effective immediately upon final passage. CI2113 - AMERICAN RESCUE PLAN ACT, FOR THE PURPOSES OF PURCHASING THE PROPERTY KNOWN AS 2701 EAST 12TH STREET, PUEBLO, CO, PERFORMING CERTAIN PROPERTY BOUNDARY CHANGES, PERFORMING CERTAIN IMPROVEMENTS, AND AUTHORIZING THE MAYOR TO EXECUTE ANY REQUIRED DOCUMENTS, AS AUTHORIZED BY SECTION 603 (A) OF THE AMERICAN RESCUE PLAN ACT AND U.S. TREASURY FINAL RULE 31 CFR 35 SUMMARY: This Resolution authorizes the payment of $180,000 in American Rescue Plan Act (“ARPA”) funds for the purpose of acquiring the property known as 2701 East 12th Street, Pueblo, Co, performing certain property boundary changes, performing certain improvements and authorizing the Mayor to execute any necessary documents. PREVIOUS COUNCIL ACTION: By Ordinance No. 9931, approved on May 17, 2021, the City Council established Project No. CI2113 and budgeted and appropriated up to $36.7 million in funds which were expected to be distributed to the City from the American Recovery Plan Act (“ARPA”) for covered costs and eligible expenses to be incurred during the period which began on March 3, 2021, until December 31, 2024, (to be expended by December 31, 2026). On February 25, 2008, City Council approved Ordinance No. 7753 which included Amendment No. 1 to the St. Anne’s Lease Agreement that extended the term of the Lease through 2018 and provided for the construction of public restrooms at the park with federal funds, requiring that the public improvements be dedicated to a public purpose for at least ten (10) years. BACKGROUND: The City of Pueblo and the Diocese of Pueblo entered into a Lease Agreement in January 2004 for a five-year period ending December 31, 2008, for use of the area adjacent to St. Anne’s Church (2701 East 12th Street) as a recreational area, park, and playground. The park includes a softball field, restroom, and a playground. The City constructed additional improvements at the park in 2016 and 2017 with Community Development Block Grant funds from the U.S. Department of Housing and Urban Development, further requiring the public improvements be dedicated to a public purpose through 2028. On January 1, 2018, the terms of the Lease allowed for automatic month-to-month renewal. In early 2023, the Diocese wanted to sell St. Anne’s Park to the City. Amendment No. 2 was approved on February 17, 2023, which extended the Lease Agreement until such time as the real property could be sold to the City, but no later than December 31, 2023. FINANCIAL IMPLICATIONS: The City will be doing the “Rearrangement of Property Boundaries” survey in February 2024 at a cost of approx. $24,000. The appraised property value for the subdivided property was estimated at $140,000. Dioceses has agreed to sell the City the property for $120,000, but the City will be required to install a fence along the new property boundary and adjust the irrigation and electrical systems. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Resolution. STAKEHOLDER PROCESS: Not applicable to this Resolution. ALTERNATIVES: The City Council could decide not to support or fund the acquisition of the property and use as a recreational facility within the City. RECOMMENDATION: Approval of the Resolution.
