A RESOLUTION APPROVING AN EASEMENT AGREEMENT
FOR BECKWOOD PARK BETWEEN THE CITY OF PUEBLO, A
COLORADO MUNICIPAL CORPORATION, AND BLACK HILLS
ENERGY FOR THE INSTALLATION OF AN UNDERGROUND
DISTRIBUTION LINE
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that
SECTION 1.
The Easement Agreement dated February 12, 2024, from the City of Pueblo to Black
Hills Energy, a copy of which is attached hereto, having been approved by the Assistant City
Attorney, is hereby accepted and approved. The Mayor is hereby authorized and directed to
execute same for and on behalf of the City and the City Clerk is directed to affix the seal of the
City thereto and attest same.
SECTION 2.
Black Hills Energy will pay the City $500.00 in compensation for the Easement
Agreement. City staff are hereby directed to transfer the anticipated funds into.
SECTION 3.
The officers and staff of the City are authorized to perform any and all acts consistent
with the intent of this Resolution which are necessary or desirable to implement the transactions
described herein.
SECTION 4.
This Resolution shall become effective immediately upon final passage.

SUMMARY:
This Resolution approves an easement to Black Hills Energy through Beckwood Park
for the purpose of allowing for the installation of an underground distribution line and
above ground cabinet.
PREVIOUS COUNCIL ACTION:
Not applicable to this Resolution.
BACKGROUND:
In December 2023, Black Hills Energy approached City through the Department of
Parks and Recreation requesting an easement through Beckwood Park, a City park, in
exchange Black Hills Energy is compensating the City $500.00. The easement would
be for the above ground cabinet in the southwest corner of Beckwood Park. Black Hills
Energy will be installing a new underground distribution line to serve the community. An
easement agreement has been drafted.
FINANCIAL IMPLICATIONS:
Once the Easement Agreement is approved, Black Hills Energy will pay the City
$500.00 in compensation.

Not applicable to this Resolution.
ALTERNATIVES:
Black Hills Energy will not be able to complete the utility line installation if the Easement
Agreement is not approved.
