HomeMy WebLinkAbout10642ORDINANCE NO. 10642 AN ORDINANCE AMENDING SECTION SEVEN OF CHAPTER FOUR OF TITLE XVII OF THE PUEBLO MUNICIPAL CODE RELATING TO LANDSCAPE PERFORMANCE STANDARDS BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. Section 17-4-7(b)(2) of the Pueblo Municipal Code is hereby amended to read as follows: Sec. 17-4-7. Landscape Performance Standard . . . (2) Applicable Zones: Unless provided through a Special Area Plan or Planned Unit Development, the provisions of this Section shall apply in the following zone districts: R-4, R-5, R-6, RCN, B-1, B-2, B-3, B-4, BP, PUD (when the PUD does not establish its own landscaping regulations), H-B, Industrial-Zoned properties in the designated high-visibility areas, O-1, CCN, S-1, S-4 and S-5 when at least one (1) of the following occurs within the above-mentioned zones: a. The construction or placement of any building or structure upon any lot. Exceptions to this requirement include constructing or placing any one (1) family, residence or two (2) family residence, and constructing or placing accessory structure(s) with a singular or cumulative ground floor area of 1,000 square feet or fewer. b. Any structural addition of thirty-five percent (35%) or more of the ground floor area \[gross square footage\] \[of\] to an existing building, except a residence, one (1) family and a residence, two (2) family. \[or\] An addition of ten thousand (10,000) square feet of ground floor area \[gross square feet\] or more \[of\] to an existing building in any \[I-2 zone\] Industrial district \[(whichever quantity is less)\]. Additional increases in floor area, based on the above zone districts, shall be a maximum allowable limit of expansion whether cumulative or not, based on structure size after 2017. SECTION 2. The officers and staff of the City are authorized to perform any and all acts consistent with the intent of the Ordinance to implement the policies and procedures described herein. SECTION 3. This Ordinance shall become effective thirty (30) days after the date of final action by the Mayor and City Council. Gradisar VIA: Marisa Stoller, City Clerk FROM: Scott Hobson, Acting Director Planning and Community Development SUBJECT: AN ORDINANCE AMENDING SECTION SEVEN OF CHAPTER FOUR OF TITLE XVII OF THE PUEBLO MUNICIPAL CODE RELATING TO LANDSCAPE PERFORMANCE STANDARDS SUMMARY: Attached for consideration is an Ordinance that amends Section 17-4-7(b),(2) of the Pueblo Municipal Code relating to Landscape Performance Standards. PREVIOUS COUNCIL ACTION: None. BACKGROUND: Currently, the Municipal Code requires developed commercial, industrial, and multifamily properties to come into full compliance with the landscaping code when any additional structure is constructed or placed on the property, regardless of size or proposed use of the building. In situations where a property was developed several years ago and the landscaping does not meet the current Landscape Performance Standards, Section 17-4-7 of the Pueblo Municipal Code, the addition of a small accessory structure, such as a storage shed, gazebo, pergola, etc., would require expensive landscape improvements to be made in conjunction with the construction or placement of that accessory structure. Requiring full landscaping for accessory structures is often a significant financial burden for property owners and a disincentive for redevelopment and investment into an existing site. The proposed amendment also includes other minor changes in the code language to improve comprehension and address provisions that currently conflict with other portions of the code. FINANCIAL IMPLICATIONS: There are no financial implications for the City. BOARD/COMMISSION RECOMMENDATION: The Planning and Zoning Commission, at their December 13, 2023, Regular Meeting, voted 7-0, to recommend approval. STAKEHOLDER PROCESS: The Planning Department sent out Notice of the Planning and Zoning Commission Public Hearing by publication of the proposed amendment fifteen (15) days prior to the Public Hearing. ALTERNATIVES: If City Council does not approve this Ordinance, Section 17-4-7(b),(2)relating to Landscape Performance Standards will remain. Upon request of City Council, the Ordinance could be returned to the Planning and Zoning Commission for consideration of proposed modifications. RECOMMENDATION: Approval of the Ordinance.
