HomeMy WebLinkAbout15466RESOLUTION NO. 15466 A RESOLUTION TO APPROVE AMENDMENT NO. 2 TO REVOCABLE PERMIT NO. REV-23-41, ISSUED TO E.T. TECHNOLOGIES, INC. FOR THE PURPOSE OF INSTALLING GROUNDWATER MONITORING WELLS WHEREAS, City Council passed Resolution No. 15365 on September 11, 2023, authorizing the issuance of Revocable Permit REV-23-41 to E.T. Technologies, Inc., for the use of the public right-of-way on West D Street and Lamkin Street to install groundwater monitoring wells; AND WHEREAS, City Council passed Resolution No. 15422 on November 13, 2023, amending Revocable Permit REV-23-41 to expand the permitted area to include a portion of the alley between Victoria Avenue and Lamkin Street extending from West D Street to West C Street for the same purpose; AND WHEREAS, E.T. Technologies, Inc., has requested a second amendment to expand the permitted area to include the public right-of-way in West C Street between Lamkin Street and the alley between Lamkin Street and Victoria Avenue for the same purpose; AND WHEREAS, the Revocable Permit Committee recommends approval of the requested amendment; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that SECTION 1. The attached Amendment No. 2 to Revocable Permit REV-23-41 is authorized to be issued to E.T. Technologies, Inc. to amend the designated permitted area for the purpose of installing groundwater monitoring wells. SECTION 2. The use of the public right-of-way granted hereby is subject to all limitations, terms, and conditions set forth in Revocable Permit REV-23-41, as amended by the attached Amendment No. 2. SECTION 3. The officers and staff of the City of Pueblo are authorized to perform any and all acts consistent with the intent of this Resolution to implement the transactions described herein. SECTION 4. This Resolution shall become effective immediately upon passage and approval. TECHNOLOGIES, INC. FOR THE PURPOSE OF INSTALLING GROUNDWATER MONITORING WELLS SUMMARY: This Resolution will amend the description of the permitted area described in Revocable Permit REV-23-41 Amendment 1 to include W. D. Street, Lamkin Street, and the alley located between Lamkin Street; S. Victoria Avenue extending from W. D Street to W. C Street; and W. C Street between Lamkin Street and the alley between Lamkin Street and Victoria Avenue authorizing the Permittee to install groundwater monitoring wells within the permitted area. PREVIOUS COUNCIL ACTION: Resolution No. 15365 was passed by City Council on September 11, 2023, approving the issuance of Revocable Permit No. REV-23-41. City Council passed Resolution No. 15422 on November 13, 2023, approving Amendment No. 1 to Revocable Permit No. REV-23-41. BACKGROUND: The Permittee has requested a second amendment to Revocable Permit No. REV-23- 41 to expand the permitted area previously authorized under the initial permit and as previously expanded by Amendment No. 1 to REV-23-41. Permittee has indicated that they intend to install additional groundwater monitoring wells consistent with the purpose of the initial Revocable Permit. All other terms and conditions of the permit will remain unchanged. FINANCIAL IMPLICATIONS: None. BOARD/COMMISSION RECOMMENDATION: The Revocable Permit Review Committee recommends approval. STAKEHOLDER PROCESS: None. ALTERNATIVES: Failure to approve the Resolution to Amend will prevent E.T. Technologies, Inc., from amending Revocable Permit REV-23-41 to authorize the installation of additional groundwater monitoring wells within West C Street between Lamkin Street and the alley between Lamkin Street and Victoria Avenue.
