A RESOLUTION AUTHORIZING THE PUEBLO URBAN
RENEWAL AUTHORITY TO CONDUCT A STUDY TO
DETERMINE WHETHER THE PROPOSED BLUFFS AREA IS A
SLUM, BLIGHTED AREA, OR COMBINATION THEREOF, AND
TO NOTIFY OWNERS OF PROPERTY IN THE AREA SUBJECT
OF STUDY.
WHEREAS, the Colorado Urban Renewal Law, Part 1 of Article 25 of Title 31 (the “Act”)
provides for urban renewal of blighted areas;
WHEREAS, the Pueblo Urban Renewal Authority wishes to conduct a Conditions Survey
to assess blighting factors, and make recommendations, if appropriate, for the purposes of
considering a redevelopment plan(s) to remove blighting conditions;
WHEREAS, the City Council of Pueblo (“Council”) hereby authorized and directs the
Pueblo Urban Renewal Authority to study an area of the City of Pueblo (“City”) to assess if
blighting factors exist in the area and, if appropriate, recommend that the City Council consider
one or more redevelopment plans to remove any such conditions of blight; NOW, THEREFORE
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that
SECTION 1.
The Pueblo Urban Renewal Authority (“Authority”) is authorized to complete a study to
determine if the proposed Bluffs areas are slum, blighted, or a combination thereof. Any actions
taken by the Authority with respect to studying the proposed Bluffs area, prior to the date of
passage of this resolution, are hereby ratify
SECTION 2.
Within thirty (30) days of the authorization of the study described in Section 1, the
Authority shall notify the owners of property in the area of such study pursuant to § 31-25-107
(1) (b) C.R.S.
SECTION 3.
Within thirty (30) days of authorizing the study described in Section 1, the Authority shall
notify each public body that levies ad valorem property tax in the study area.
SECTION 4.
The officers and staff of the City are authorized to perform any acts consistent with this
Resolution to implement the policies and procedures described herein.
SECTION 5.
This resolution shall become effective immediately upon passage and approval.

SUMMARY:
This resolution authorizes the Pueblo Urban Renewal Authority (PURA) to conduct a
study to identify blighting factors within the proposed Bluffs Area in conjunction with the
Bluffs Phase 1 development project.
PREVIOUS COUNCIL ACTION:
Not Applicable to this Resolution.
BACKGROUND:
The Bluffs area encompasses five (5) parcels and approximately 3.3 acres, including
Right-of-Way (ROW). The area is characterized by vacant land clustered atop a steep
bluff within City limits, overlooking the Arkansas River. Public surface infrastructure,
from streets and alleyways to the trails leading down to the River, is in disrepair. The
survey area is also within “Superfund Proximity”, according to the EPA’s Environmental
Justice Indexes website. A Conditions Survey will evaluate this area for statutorily
defined “blighted area factors” (blighting factors). Colorado’s Urban Renewal Law
defines these factors under C.R.S. 31-25-103 (2) and in general, mean conditions that
impair or arrest the sound growth of a municipality. The Conditions Survey will locate,
identify, and describe each statutorily defined blighting factor found within the proposed
plan area and help the City determine whether an Urban Renewal Area and Project
would assist the City in alleviating blight and spurring redevelopment.

None.

STAKEHOLDER PROCESS:
Not applicable to this Resolution.
ALTERNATIVES:
The attached Resolution is the first necessary step to enlist the assistance of PURA in
utilizing tax increment financing to revitalize the area. A “no action” alternative would
prevent PURA's involvement and require a vote of the people for any tax increment
financing.
RECOMMENDATION:
Approval of the Resolution.
