HomeMy WebLinkAbout10624ORDINANCE NO. 10624 AN ORDINANCE ESTABLISHING FUND NO. 236 - PLASTIC POLLUTION REDUCTION AND BUDGETING AND APPROPRIATING ALL FUNDS RECEIVED BY THE CITY OF PUEBLO UNDER THE PLASTIC POLLUTION REDUCTION ACT AND ALL FUTURE PAYMENTS RECEIVED FROM THE PLASTIC POLLUTION REDUCTION ACT IN FUND NO. 236. BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. Fund No. 236 is hereby established, and all funds which have been collected and will be paid to the City in accordance to the Plastic Pollution Reduction Act (HB21-1162), pursuant to Chapter 3 of Title VII of the Pueblo Municipal Code, Article IV - Plastic Pollution Reduction Act, Section 7-3-48. - Payment to and administration of the Carryout Bag Fees by the City, are hereby budgeted and appropriated into said Fund No. 236. SECTION 2. The officers and staff of the City are authorized to perform any and all acts consistent with this Ordinance to implement the policies and procedures described herein. SECTION 3. This Ordinance shall become effective on the date of final action by the Mayor and City Council. Gradisar VIA: Marisa Stoller, City Clerk FROM: Alexandria Romero, Director of Finance SUBJECT: AN ORDINANCE ESTABLISHING FUND NO. 236 - PLASTIC POLLUTION REDUCTION AND BUDGETING AND APPROPRIATING ALL FUNDS RECEIVED BY THE CITY OF PUEBLO UNDER THE PLASTIC POLLUTION REDUCTION ACT AND ALL FUTURE PAYMENTS RECEIVED FROM THE PLASTIC POLLUTION REDUCTION ACT IN FUND NO. 236. SUMMARY: This Ordinance establishes Fund No. 236 - Plastic Pollution Reduction, and budgets and appropriates funds which have been and will be collected by the City of Pueblo for Carryout Bag Fees pursuant to Chapter 3 of Title VII of the Pueblo Municipal Code, Article IV - Plastic Pollution Reduction Act, Section 7-3-48. - Payment to and administration of the Carryout Bag Fees by the City. PREVIOUS COUNCIL ACTION: On December 27, 2022, by Ordinance No. 10361, City Council authorized amending Chapter 3 of Title VII of the Pueblo Municipal Code by adding a new Article IV relating to the carryout bag fees imposed pursuant to the Plastic Pollution Reduction Act and providing for the enforcement, collection, remittance, and distribution of said fees. BACKGROUND: On July 6, 2021, Governor Jared Polis signed into law the Plastic Pollution Reduction Act (HB21-1162). Beginning January 1, 2023, certain retailers will be required to collect a $0.10 fee for every recycled paper or single-use plastic carryout bag provided to a customer for his or her use. According to the Act, sixty percent (60%) of the fee is required to be remitted to the municipality where the transaction occurred. The Act provides that the funds received by the municipality where the transaction occurred are to be separated from other funds and used for specific purposes related to the implementation of this legislation. The attached Ordinance establishes the special revenue fund and budgets and appropriates funds collected under the Plastice Pollution Reduction Act. FINANCIAL IMPLICATIONS: The attached ordinance budgets and appropriates all funds that have been and will be collected from the Plastic Pollution Reduction Act to be received by the City into Fund No. 236. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Ordinance. STAKEHOLDER PROCESS: Not applicable to this Ordinance. ALTERNATIVES: Failure to adopt this Ordinance will result in the City Council not authorizing the establishment of Fund No. 236 and the budgeting and appropriation of funds in the Plastic Pollution Reduction Fund No. 236.
