Gradisar VIA: Marisa Stoller, City Clerk FROM: Andra Ahrens, Director Wastewater SUBJECT: AN ORDINANCE APPROVING AN AGREEMENT FOR PROFESSIONAL ENGINEERING SERVICES IN THE AMOUNT OF $566,050 BETWEEN THE CITY OF PUEBLO, A COLORADO MUNICIPAL CORPORATION, AND BROWN AND CALDWELL, INC., FOR CONSULTING ENGINEERING AND PROJECT MANAGEMENT SERVICES WITH RESPECT TO UPGRADING THE JAMES R. DILORIO WATER RECLAMATION FACILITY’S ROCKWELL AUTOMATION FACTORYTALK VIEW SUPERVISORY CONTROL AND DATA ACQUISITION (SCADA) SYSTEM AND AUTHORIZING THE MAYOR TO EXECUTE THE SAME SUMMARY: This Ordinance accepts an agreement between the City of Pueblo and Brown and Caldwell, Inc. for consulting engineering services relating to upgrade the James R. Dilorio Water Reclamation Facility’s Rockwell Automation FactoryTalk View Supervisory Control and Data Acquisition (SCADA) system. PREVIOUS COUNCIL ACTION: On November 12, 2018, the City Council Approved Resolution No. 14081, selecting Brown and Caldwell, Inc as the Engineer of Record for the Wastewater Treatment Department. BACKGROUND: The City of Pueblo has requested Brown and Caldwell to upgrade the James R. Dilorio Water Reclamation Facility’s Rockwell Automation FactoryTalk View Supervisory Control and Data Acquisition (SCADA) system. The SCADA controls all the programmable logic control (PLC), the PLC controls all the automation throughout the plant. If the SCADA system were to fail, the plant would have to be staffed twenty-four hours a day to insure all the processes are functioning properly. Operators rely on this system to operate and monitor this facility safely and efficiently. Over the years, this system has been developed to meet the needs of the operating staff. However, the current version of the software is no longer supported by the current computer systems. The current software requires Windows 7 operating system that is no longer supported by Microsoft and is susceptible to cybersecurity attacks. With the SCADA software version, the City of Pueblo has limited options to maintain a functioning SCADA system and is at risk of irreversible damage or data loss. FINANCIAL IMPLICATIONS: The cost of the agreement with Brown and Caldwell to provide design services for the rehabilitation project will not exceed $566,050. Funds are available from the WRF Facility Rehab (WWAN04). DILORIO WATER RECLAMATION FACILITY’S ROCKWELL AUTOMATION FACTORYTALK VIEW SUPERVISORY CONTROL AND DATA ACQUISITION (SCADA) SYSTEM AND AUTHORIZING THE MAYOR TO EXECUTE THE SAME WHEREAS, the Pueblo Wastewater Department operates a Water Reclamation Facility system providing municipal wastewater treatment and WHEREAS, consulting engineering required with respect to upgrade the James R. Dilorio Water Reclamation Facility’s Rockwell Automation FactoryTalk View Supervisory Control and Data Acquisition (SCADA) system and WHEREAS, Brown and Caldwell is the consulting Engineer of Record and is the most qualified to serve the Pueblo Wastewater Department for such project; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. An agreement by and between the City of Pueblo, a Municipal Corporation, and Brown and Caldwell, Inc., a copy of which is attached hereto and made part hereof by reference (“Agreement”), after having been approved as to form by the City Attorney, is hereby approved. SECTION 2. Work Performed under the Agreement may include, but not limited to, the following items: 1. Project management and Administration: 2. Existing Conditions Assessment: 3. SCADA Standard Development: 4. SCADA System Programming: 5. System Commissioning and Post Installation Support: SECTION 3. The Mayor is hereby authorized to execute said Agreement on behalf of Pueblo, a Municipal Corporation, and the City Clerk shall affix the seal of the City thereto and attest the same. SECTION 4. Funds for work performed under this agreement shall be from the WRF Facility Rehab (WWAN04). SECTION 5. The officers and staff of the City are authorized to perform any and all acts consistent with the intent of this Ordinance and the Agreement approved to implement the transactions described therein. SECTION 6. This Ordinance shall become effective on the date of final action by the Mayor and City Council.
