HomeMy WebLinkAbout10604ORDINANCE NO. 10604 AN ORDINANCE APPROVING AN AGREEMENT OF PURCHASE AND SALE OF REAL PROPERTY BETWEEN COMMUNITY HEALTH CENTER INC., AND THE CITY OF PUEBLO FOR THE PURCHASE OF 1302 EAST 5TH STREET PUEBLO, COLORADO 81001 IN THE AMOUNT OF FOUR HUNDRED THIRTY EIGHT THOUSAND TWO HUNDRED SEVENTY ONE DOLLARS AND NO CENTS ($438,271) TO BE PAID FROM PROJECT NO. CI-2113, AMERICAN RESCUE PLAN ACT, AS AUTHORIZED BY SECTION 603 (A) OF THE AMERICAN RESCUE PLAN ACT AND U.S. TREASURY FINAL RULE 31 CFR 35 AND AUTHORIZING THE MAYOR TO EXECUTE THE SAME BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Agreement of Purchase and Sale of Real Property (“Agreement”) between Pueblo, a Colorado Municipal Corporation and Community Health Center Inc., attached hereto, is hereby approved. SECTION 2. Funds in the amount of Four Hundred Thirty-Eight Thousand Two Hundred Seventy One Dollars ($438,271) are hereby authorized for payment from Project No. CI-2113 – American th Rescue Plan Act, for purposes of purchasing 1302 East 5 Street, Pueblo, Colorado 81001. SECTION 3. After the Agreement is approved as to form by the Department of Law, the Mayor is hereby authorized to execute said Agreement for and on behalf of the City and the City Clerk is authorized to affix the seal of the City thereto and attest same. SECTION 4. The officers and staff of the City are authorized to perform any and all acts consistent with this Ordinance and the attached Agreement to implement the policies and procedures described therein. SECTION 5. This Ordinance shall become effective on the date of final action by the Mayor and City Council. CI-2113, AMERICAN RESCUE PLAN ACT, AS AUTHORIZED BY SECTION 603 (A) OF THE AMERICAN RESCUE PLAN ACT AND U.S. TREASURY FINAL RULE 31 CFR 35 AND AUTHORIZING THE MAYOR TO EXECUTE THE SAME SUMMARY: th This Ordinance approves an agreement for the purchase and sale of 1302 East 5 Street, Pueblo, Colorado 81001 from Community Health Center Inc., to the City of Pueblo, a Colorado Municipal Corporation and authorizes the payment of $438,271.00 in American Rescue Plan Act (“ARPA”) funds to complete the acquisition. PREVIOUS COUNCIL ACTION: By Ordinance No. 9931, approved on May 17, 2021, the City Council established Project No. CI-2113 and budgeted and appropriated up to $36.7 million in funds which were expected to be distributed to the City from the American Recovery Plan Act (“ARPA”) for covered costs and eligible expenses to be incurred during the period which began on March 3, 2021, until December 31, 2024, (to be expended by December 31, 2026). BACKGROUND: Under the U.S. Treasury’s Final Rule pertaining to ARPA, recipients of may use Coronavirus State and Local Fiscal Recovery Funds (“SLFRF”) for a program, service, capital expenditure, or other assistance that mitigates the negative economic impacts of the COVID-19 pandemic to include assistance to households such as job training, rent, mortgage, or utility aid, affordable housing development, childcare; assistance to small businesses or nonprofits such as through loans or grants to mitigate financial hardship; assistance to impacted industries like travel, tourism, and hospitality that faced substantial pandemic impacts; or assistance to address impacts to the public sector. FINANCIAL IMPLICATIONS: $438,271 in ARPA funds are being authorized for payment. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Ordinance. STAKEHOLDER PROCESS: Not applicable to this Ordinance. ALTERNATIVES: City Council could decide not to support or fund the acquisition of the 1302 East 5th Street Property for availability of affordable housing within the City.
